Price Order No. 679 (Amending Price Order No. 668) (Milk and Cream)

PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following amending Price Order:

  1. This Order may be cited as Price Order No. 679, and shall be read together with and deemed part of Price Order No. 668† (hereinafter referred to as the principal Order).

  2. This Order shall come into force on the 25th day of April, 1947.

  3. The Schedule set out in subclause (1) of clause 4 of the principal Order is hereby amended by omitting the heading “Cream” and all references to the price of cream and substituting the following heading and references:—

“Cream

Price Order No. 680 (Cream sold to Cream-vendors)

PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:—

PRELIMINARY

  1. This Order may be cited as Price Order No. 680, and shall come into force on the 1st day of May, 1947.

  2. (1) Price Orders No. 436† and No. 472‡ are hereby revoked.

(2) The revocation of the said Orders shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.

  1. (1) In this Order, unless the context otherwise requires,—

“Cream” has the same meaning as in regulations made under the Sale of Foods and Drugs Act, 1908:

“Cream-vendor” means a person who sells cream by way of retail sale, but does not include—

(a) A person occupying a shop where cream is sold for consumption or use off the premises and not otherwise and where the cream is sold in the form in which it is received into the shop; or

(b) A person who sells cream for consumption on his premises (whether in the form in which it is received by him or otherwise and whether separately or in combination with any other substance or substances):

“Gallon”, when used with reference to cream, means 9·95 lb. by weight or 160 fluid ounces by measure.

(2) References in this Order to milk districts are references to the following milk districts: Auckland Metropolitan, Balclutha, Christchurch Metropolitan, Dannevirke, Dunedin, Eltham, Feilding, Gisborne, Hamilton, Hastings, Hutt Valley and Bays Metropolitan, Invercargill, Napier, Nelson, New Plymouth, Oamaru, Palmerston North Metropolitan, Rotorua, Stratford, Tauranga, Timaru, Wanganui, Westport, Whangarei, Ashburton, Greymouth, Hawera, Waipukurau, Te Puke, Whakatane, Levin, Lyttelton, and Kaiapoi-Rangiora, being the district defined in Price Order No. 506§ and the districts defined in the several Price Orders to which Price Order No. 668|| applies respectively.

APPLICATION OF THIS ORDER

  1. This Order applies only with respect to cream sold to a cream-vendor for sale by way of retail in any milk district to which this Order applies during the months of May to September (inclusive) in any year.

FIXING MAXIMUM PRICES OF CREAM TO WHICH THIS ORDER APPLIES

  1. The maximum price that may be charged or received for any cream to which this Order applies shall be—

For ¼ pint bottles, or 4 oz. cartons: 6d. each.

For ½ pint bottles, or 8 oz. cartons: 1s. each.

For 1 pint bottles, or 16 oz. cartons: 2s. each.

For loose cream in a quantity of less than 2 pints: At the rate of 2s. per pint.

For loose cream in a quantity of 2 pints or more: At the rate of 15s. 8d. per gallon.
