shall be one) that any appeal or other proceeding is of special
difficulty or importance, authorize all the Judges of the other
Division to sit together with those of the former Division for the
hearing and determination of that appeal or proceeding:
And whereas at the sitting of the Second Division. of the
Court of Appeal which commenced on Monday, the third day of
March, one thousand nine hundred and forty-seven, an appeal
by Harold John Rayner against Hubert Harry Daniell and others in
the matter of the will of William Evinson Rayner, now deceased, stood
for hearing and determination :
And whereas the Court decided that such hearing and
determination should stand adjourned until Monday, the ninth
day of June, one thousand nine hundred and forty-seven, at the
hour of 11 o'clock in the forenoon:
And whereas the Honourable Sir Francis Humphrey O'Leary,
K.C.M.G., Chief Justice of New Zealand, and the Honourable
David Stanley Smith, a Judge of the Supreme Court of New
Zealand, have certified that the said appeal presents a question
of special difficulty and importance:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, in pursuance of the authority vested
in him in that behalf as aforesaid, and acting by and with the advice
of the Executive Council of the said Dominion, doth hereby authorize the Judges of the Second Division of the Court of Appeal to
sit with the Judges of the First Division of that Court at the afore-
said sitting for the hearing and determination of the said appeal.

PURSUANT to section forty of the Statutes Amendment Act,
1946, and all other powers him enabling, His Excellency the
Governor-General of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council, doth hereby
authorize the disposition to and the acquisition by Huia John
Anderson Hill, of Whitecliffs, Farmer, of the land described in the
Schedule hereto, notwithstanding the provisions of section one
hundred and seven of the Land Act, 1924.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
WHEREAS the land described in the Schedule hereto is a
reserve for gravel purposes and is vested in the Pohangina
County Council:
And whereas it is expedient that the vesting of the said land
as hereinbefore referred to should be cancelled, and the Pohangina
County Council has duly consented to such cancellation:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred
upon him by subsection one of section ten of the Public Reserves,
Domains, and National Parks Act, 1928, doth hereby cancel the
vesting in the Pohangina County Council of the land described in
the Schedule hereto.

BY virtue of the powers and authorities vested in me by the
thirty-fourth section of the Public Reserves, Domains, and
National Parks Act, 1928, I, Lieutenant-General Sir Bernard Cyril
Freyberg, the Governor-General of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive Council
of the said Dominion, do hereby order and declare that the reserve
for recreation in the North Auckland Land District described in
the Schedule hereto shall be and the same is hereby brought under
the operation of and declared to be subject to the provisions of
Part II of the said Act, and such reserve shall hereafter form part
of the Rosebank Park Domain, and be managed, administered, and
dealt with as a public domain by the Rosebank Park Domain
Board.
