Boundaries of City of Christchurch and County of Waimairi altered

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 19th day of March, 1947

Present:

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

WHEREAS, in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area be excluded from the County of Waimairi and included in the City of Christchurch:

And whereas it is deemed expedient to make such alteration of boundaries:

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-seven, the area described in the Schedule hereto shall be excluded from the County of Waimairi and included in the City of Christchurch.

SCHEDULE

AREA EXCLUDED FROM COUNTY OF WAIMAIRI AND INCLUDED IN CITY OF CHRISTCHURCH

ALL that area in the County of Waimairi, Canterbury Land District, situated in Block XII, Christchurch Survey District, and bounded by a line commencing at a point on the boundary of the City of Christchurch, such point being on the right bank of the River Avon in line with the western side of Gayhurst Road, proceeding generally northerly across the River Avon and Dallington Terrace, to and along the western side of Gayhurst Road to McBratney's Road; thence westerly along the southern side of that road to Dallington Terrace, and the production of the last-mentioned line to a point on the boundary of the City of Christchurch; thence generally in a southerly direction along that boundary to the point of commencement.

Consenting to the Raising of a Loan of £15,000 by the Southland Hospital Board and prescribing the Conditions thereof

At the Government Buildings at Wellington, this 19th day of March, 1947

Present:

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

WHEREAS the Southland Hospital Board (hereinafter called the said local authority), being desirous of raising a loan of fifteen thousand pounds (£15,000), to be known as “Southland Hospital Boiler Installation Loan, 1946” (hereinafter called the said loan), for the purpose of installing new boilers at the Southland Hospital, Kew, has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of fifteen thousand pounds (£15,000), and in giving such consent doth hereby determine as follows:—

(1) The term for which the said loan or any part thereof may be raised shall not exceed twenty-five (25) years.

(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds five shillings (£3 5s.) per centum per annum.

(3) The said loan or any part thereof shall be repaid by equal annual instalments of principal extending over the term as determined in (1) above.

(4) The payment of interest and principal in respect of the said loan shall be made in New Zealand.

(5) No amount payable either as interest or as principal in respect of the said loan shall be paid out of loan-money.

(6) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(7) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for a garage for electric trolley buses and motor-omnibuses.
