WISE, Member.Price Order 661 (Dates)PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939, the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:1. This Order may be cited as Price Order No. 661, and shall come into force on the 27th day of February, 1947.2. (1) Price Order No. †533 is hereby revoked.(2) The revocation of the said Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.APPLICATION OF THIS ORDER3. This Order applies with respect to all dates imported as bulk dates and sold in New Zealand in the form in which they are received whether in the original containers or otherwise.FIXING MAXIMUM PRICES OF DATES TO WHICH THIS ORDER APPLIESWholesalers' Prices4. (1) Subject to the following provisions of this clause the maximum price that may be charged or received by any retailer for any dates to which this Order applies shall be determined as follows:—(a) When sold by a retailer whose premises are situate in any area within which any wholesaler carrying on business in any of the cities of Auckland, Wellington, Christchurch, or Dunedin normally undertakes the free delivery of goods to retailers, the maximum price shall be—Per Pound :At the Rate of(i) For Khadrawi (Khadrowee) dates— s. d.Pitted (stoned) .. .. 1 0½Whole (unstoned) .. .. 0 10(ii) For Sair (Sayer) dates—Pitted (stoned) .. .. 0 11½Whole (unstoned) .. .. 0 9(iii) For any other dates—Pitted (stoned) .. .. 0 10Whole (unstoned) .. .. 0 7(b) When sold by a retailer whose premises are situated elsewhere the prices fixed by paragraph (a) hereof may be increased by ½d. per pound.(2) If in respect of any lot of dates sold by a retailer the maximum price, calculated in accordance with the foregoing provisions of this clause, is not an exact number of pence or half-pence, the maximum price of the lot shall be computed to the nearest upward halfpenny.Special Prices where Extraordinary Charges incurred6. Notwithstanding anything in the foregoing provisions of this Order and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any wholesaler or retailer, may authorize special maximum wholesale or retail prices in respect of any dates to which this Order applies where for any reason extraordinary charges (freight or otherwise) are incurred by the wholesaler or retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of dates or may relate generally to all dates to which this Order applies sold by the wholesaler or retailer while the approval remains in force.Duty imposed on Retailers7.
