Consenting to the Raising of the Balance (£18,800) of the Marlborough
Hospital Board’s Loan of £33,000 and prescribing the Conditions
thereof

At the Government Buildings at Wellington, this 6th day of
February, 1946

Present:

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

WHEREAS by Order in Council made on the tenth day of
November, one thousand nine hundred and forty-three,
and subject to the determinations as to borrowing and repayment
therein set out, consent was given to the raising by the Marlborough
Hospital Board (hereinafter called “the said local authority”) of a
loan of thirty-three thousand pounds (£33,000), to be known as
“Building Extension Loan, 1943”:

And whereas by Order in Council made on the twenty-fourth
day of November, one thousand nine hundred and forty-three,
certain of the determinations aforesaid were varied:

And whereas a portion of the said loan amounting to fourteen
thousand two hundred pounds (£14,200) has been raised and the
authority conferred by the Order in Council made on the tenth day
of November, one thousand nine hundred and forty-three, has not
been exercised to the extent of eighteen thousand eight hundred
pounds (hereinafter called “the said sum”):

And whereas the authority has lapsed in accordance with the
provisions of clause six of the said Order in Council, and it is not now
lawful or competent for the said local authority to raise the said sum
or any portion thereof except in accordance with the provisions of a
further Order in Council that may be issued pursuant to section
eleven of the Local Government Loans Board Act, 1926 (hereinafter
called “the said Act”):

And whereas it is expedient to authorize the said local authority
to raise the said sum on the conditions hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred on
him by section eleven of the said Act, as set out in section twenty-
nine of the Finance Act, 1932 (No. 2), and of all other powers and
authorities enabling him in this behalf, doth hereby consent to the
raising in New Zealand by the said local authority of the said sum
up to the amount of eighteen thousand eight hundred pounds
(£18,800), and in giving such consent doth hereby determine as
follows:—

(1) The determinations prescribed in the Order in Council made
on the tenth day of November, one thousand nine hundred and
forty-three, as varied by the Order in Council made on the twenty-
fourth day of November, one thousand nine hundred and forty-three,
shall remain in full force and effect in respect of the sum of fourteen
thousand two hundred pounds (£14,200) already raised thereunder,
and also in respect of the said sum of eighteen thousand eight hundred
pounds (£18,800), except that in respect of the said sum of eighteen
thousand eight hundred pounds (£18,800) the determination set out
in clause six of the Order in Council made on the tenth day of
November, one thousand nine hundred and forty-three, shall not
apply.

(2) No part of the said sum of eighteen thousand eight hundred
pounds (£18,800) shall be borrowed under this consent after the
expiration of two years from the date hereof.

Constituting the Hauraki Catchment District

At the Government Buildings at Wellington, this 13th day of
February, 1946

Present:

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred upon him by
the Soil Conservation and Rivers Control Act, 1941, and of
every other power in anywise enabling him in that behalf, His
Excellency the Governor-General of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby constitute and declare the parts
of New Zealand described in the Schedule hereto a catchment district
under the said Act as from this thirteenth day of February,
one thousand nine hundred and forty-six, and doth hereby
assign to such catchment district the name of the “Hauraki
Catchment District.”

ALL those areas in the Auckland Land District and comprising:—

The Hauraki Plains County (New Zealand Gazette, 1936, page
842).

The Borough of Thames (Thames Borough Alteration Act,
1918) (New Zealand Gazette, 1919, page 2479).

The Borough of Paeroa (New Zealand Gazette, 1925, page 570).

The Borough of Waihi (New Zealand Gazette, 1926, page 3045).

The Borough of Morrinsville (New Zealand Gazette, 1921,
page 1263).

The Borough of Matamata (New Zealand Gazette, 1934, page
3772).

The Borough of Te Aroha (New Zealand Gazette, 1917, page
1868).

The Town District of Putaruru (New Zealand Gazette, 1926,
page 2617).

Also all that portion of the Thames County, bounded by a line
commencing in Block I, Thames Survey District, and being a point
on the northern boundary of the Borough of Thames where it is
intersected by the line of mean high water of the Firth of Thames,
and running northerly along the said line of mean high water to the
eastern end of the south-eastern boundary of Waihoanga No. 1
Block; thence north-easterly generally along that boundary, the
south-eastern boundary of Waihoanga No. 2 Block, the southern
and eastern boundaries of Section 18, Block I, Thames Survey
District, the eastern boundary of Karioi No. 1 Block, the southern
boundaries generally of Sections 20, Block I, and 3, Block II,
Thames Survey District, and the southern and eastern boundaries
of Te Wharau Block to Trig. Station 1091; thence along a right
line to Trig. Station 97 (Table Mountain), and easterly and southerly
along the southern and western boundaries of Te Tipi Block, the
western boundaries of Tairua, Puketui, and part Taparahi No. 1
Block, and a right line being the last-mentioned boundary produced
across a public road; thence easterly along the southern side of
that road to its intersection with the south-western boundary of
Pakirarahi No. 2B 3 Block; thence again southerly along the said
south-western boundary, the western boundaries of Sections 2 and
3, Block XIII, Tairua Survey District, the north-western and
south-western boundaries of Section 1, Block XIII aforesaid, and
a right line being the last-mentioned boundary produced across a
public road; thence easterly generally along the southern side of
that road, to and along the south-western boundary of Section 5
of the said Block XIII, and the southern boundary of Section 1,
Block II, Ohinemuri Survey District, to and up the left bank of the
Tairua River to a point being the production north-easterly of the
north-western boundary of Section 6 of the said Block II; thence
again southerly generally along a right line, to and along the western
boundaries of Section 6 aforesaid, and a right line being the southern
end of the last-mentioned boundary produced across a public road,
along the southern side of that road, to and along the south-western
boundary of Section 3, Block II aforesaid, to the county boundary,
as described in New Zealand Gazette, 1937, page 235; thence
westerly and northerly generally along the said county boundaries
to the point of commencement.

Also all that portion of the Ohinemuri County, bounded by a
line commencing at a point on the northern boundary of the said
county where it is intersected by the south-western boundary of
Section 3, Block II, Ohinemuri Survey District, and running southerly
generally along the said south-western boundary to Trig. Station 89
(Ngapuketura); thence along a right line to the northern corner
of Section 6, Block VI, Ohinemuri Survey District, and along its
eastern boundary and the eastern boundaries of Section 3, Block VI,
Sections 9, 18, 13, 21, and 8, Block XI, Ohinemuri Survey District
aforesaid; thence easterly generally along the northern boundary
of Section 10 and the western and northern boundaries of Section 6,
both of the said Block XI, and a right line being the last-mentioned
boundary produced across a public road, to and along the western
and northern boundaries of Section 18 of Block XII of the said
Ohinemuri Survey District to a point being the production south-
westerly of the north-western boundary of Section 2, Block XII
aforesaid; thence along a right line across a public road, to and
along the said north-western boundary, the western, northern, and
eastern boundaries of Section 14, the eastern boundary of Section 1,
both of the said Block XII, and the northern boundary of Section 5,
Block II, Waihi North Survey District, and a right line, being the
production of the last-mentioned boundary, to the sea; thence
southerly, westerly, northerly, again westerly and southerly and
easterly along the county boundary (and being along the boundaries
of the Borough of Waihi) to the north-eastern corner of Section 37,
Block IV, Aroha Survey District; thence south-westerly generally
along the south-western boundary of Lot 1 on D.P. 25021, being
part of Section 5, Block I, Katikati North Survey District, to and
along the north-western boundaries of Sections 55, 46, and 56,
Block IV aforesaid, and the western boundary of the last-mentioned
section to the Waihi–Tauranga Railway; thence along the northern
side of the said railway to a point being the production north-
easterly of the north-western boundary of Section 44 of the said
Block IV; thence along a right line across the said railway to and
along the said north-western boundary; along the south-western
boundaries of the said Section 44 and Sections 43 and 50, both of the
said Block IV, Aroha Survey District, to and along the north-
western boundaries of Sections 2 and 1, Block XII, Katikati Survey
District, to the county boundary, as described in New Zealand
Gazette, 1937, page 1198; thence south-westerly, northerly, and
easterly generally by the said county boundary to the point of
commencement, excepting therefrom the Borough of Paeroa.

Also all that portion of the Piako County, bounded by a line
commencing at a point on the county boundary, as described in
New Zealand Gazette, 1945, page 258, being the northern corner of
Section 3, Block I, Waitoa Survey District, and running easterly,
southerly, westerly, and northerly generally along the said county
boundary to the south-western corner of part Lot 1 on D.P. 3622,
being part of Motumaho No. 1 Block; thence easterly generally
along the southern and eastern boundaries of that section to a point
being the production westerly of the southern boundary of Lot 6
on D.P. 6823, being part of the said Motumaho No. 1 Block;
thence along a right line across a public road, to and along the said
southern boundary and the eastern boundaries of the said Lot 6
and Lots 5 and 4 on the said D.P. 6823, to and along the southern
boundary of Lot 2 on D.P. 27963, being part of Hangawera Block,
and the southern and eastern boundaries of Lot 9A on D.P. 2463,
being part of Hangawera Block aforesaid, to the north-eastern
corner of that lot; thence northerly generally along a right line,
across a public road to the southern corner of Section 13, Block I,
Maungakawa Survey District, and along its eastern boundary to
