THE WESTERN SIDE OF PORTION OF GREY STREET, in the Borough of Marton,
exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 26th day of
November, 1946
Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
Pursuant to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said Dominion,
doeth hereby approve of the following resolution passed by the
Marton Borough Council on the ninth day of October, one thousand
nine hundred and forty-six, in so far as it affects the side and portion
of street described in the Schedule hereto, viz.:-
"That the Marton Borough Council, being the local
authority having control of the streets in the Borough of
Marton, by resolution declares that the provisions of section
one hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to that portion of Grey Street adjoining that
piece of land situate in the Borough of Marton, being part
Section 17, R.A.R., and being Allotment Nos. 77, 78, 79, and
Part 80, Deposited Plan No. 14, Certificate of Title 234/165";
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of the
portion of Grey Street (described in the Schedule hereto) within a
distance of thirty-three feet from the centre-line of the said portion
of street.
SCHEDULE
The western side of all that portion of street situated in the
Wellington Land District, Borough of Marton, known as Grey Street,
fronting Lot 77, D.P. 14, being part Section 17, Rangitikei Agri-
cultural Reserve. As the same is more particularly delineated on
the plan marked P.W.D. 124481, deposited in the office of the
Minister of Works at Wellington, and thereon coloured red.

PUBLIC WORKS ACT, 1928, subject to a Condition as to the Building-
line

At the Government Buildings at Wellington, this 26th day of
November, 1946
Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
Pursuant to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the Devonport Borough
Council on the twenty-first day of August, one thousand nine hundred
and forty-six, viz. :-
"That the Devonport Borough Council, being the local
authority having control of the streets in the Borough of
Devonport, by resolution declares that the provisions of section
one hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to the western side of the portion of Garden
Terrace adjoining part of Allotments 23 and 23A, Section 2,
Parish of Takapuna, comprised in Certificate of Title 119/82";
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of the
portion of Garden Terrace (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said portion
of street.

SCHEDULE
The western side of all that portion of street situated in the North
Auckland Land District, Borough of Devonport, known as Garden
Terrace, fronting part Allotments 23 and 23A of Section 2, Parish of
Takapuna, being Lot 2 on Deposited Plan 3043s, and the piece of
land marked "Right-of-way" shown on the said plan. As the
same is more particularly delineated on the plan marked
P.W.D. 124113, deposited in the office of the Minister of Works at
Wellington, and thereon coloured red.

of Marlborough, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to the
Building-line

November, 1946

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
Pursuant to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said Dominion,
doeth hereby approve of the following resolution passed by the
Marlborough County Council on the fourteenth day of June, one
thousand nine hundred and forty-six, viz. :-
"The Marlborough County Council, being the local authority
having control of the roads in the Marlborough County, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the northern portion of public road fronting sub-
division of part Section 95, Waitohi Valley, Block XII, Cloudy
Bay Survey District, and contained in the Certificate of Title
32/278";
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the northern side of the
portion of unnamed road (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said portion
of road.
SCHEDULE
The northern side of all that portion of an unnamed road situated
in the Marlborough Land District, County of Marlborough, fronting
part Section 95, District of Waitohi Valley, Block XII, Cloudy Bay
Survey District. As the same is more particularly delineated on
the plan marked P.W.D. 124207, deposited in the office of the Minister
of Works at Wellington, and thereon coloured red.

Wanganui, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the Building-
line

Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
Pursuant to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion, doth
hereby approve of the following resolution passed by the Wanganui
City Council on the fifteenth day of October, one thousand nine
hundred and forty-six, in so far as it affects the side and portion
of street described in the Schedule hereto, viz. :-
"That the Wanganui City Council, being the local autho-
rity having control of the streets in the City of Wanganui, by
resolution declares that the provisions of section one hundred
and twenty-eight, subsection one, of the Public Works Act,
1928, shall not apply to that portion of the street known as
Eastown Road adjoining Lots 7, 9, and 10 on Deeds Plan 51,
part Section 89, Left Bank, Wanganui River, a distance of
275.26 links";
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the north-eastern side
of the portion of Eastown Road (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-line of the
said portion of street.
SCHEDULE
The north-eastern side of all that portion of street situated in the
Wellington Land District, City of Wanganui, known as Eastown
Road, fronting Lots 7, 9, and 10, Deeds Plan 51, being part Section 89,
Left Bank, Wanganui River. As the same is more particularly
delineated on the plan marked P.W.D. 124478, deposited in the
office of the Minister of Works at Wellington, and thereon coloured
red.
