Foreshore License.—Boat Harbour.—Lakeside Domain, Lake Ellesmere

At the Government Buildings at Wellington, this 20th day of November, 1946
Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
Pursuant to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit the Ellesmere Aquatic Club (hereinafter called the licensee, which term shall include its successors or assigns, unless the context requires a different construction), to use and occupy a part of the foreshore and land below low-water mark at Lakeside Domain, Lake Ellesmere, as shown on plan marked M.D. 8526 and deposited in the office of the Marine Department at Wellington, for the purpose of constructing a boat harbour thereon as shown on the said plan, such license to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.
SCHEDULE
CONDITIONS

  1. This license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, as far as applicable, apply hereto.
  2. The premium payable by the licensee shall be two pounds ten shillings (£2 10s.), and the annual sum so payable by the licensee shall be one pound.
  3. The term of the license shall be fourteen years from the 1st day of November, 1946.

    Authorizing the Acquisition of Land notwithstanding the Provisions as to Limitations of Area

    Present:
    THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
    Pursuant to section forty-one of the Statutes Amendment Act, 1945, and section forty of the Statutes Amendment Act, 1946, and all other powers him enabling, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the disposition to and the acquisition by Isaac John McDonald Stevenson, of Cromwell, Farmer, of the freehold land described in the First Schedule hereto, notwithstanding the provisions of Part XIII of the Land Act, 1924, and of the leasehold land described in the Second Schedule hereto, notwithstanding the provisions of section 107 of the Land Act, 1924.
    FIRST SCHEDULE
    OTAGO LAND DISTRICT
    All that area containing 59 acres 0 roods 10 perches, being Section 79, Block III, Cromwell Survey District, and being all the land comprised in Certificate of Title, Volume 203, folio 278 (Otago Registry).
    SECOND SCHEDULE
    OTAGO LAND DISTRICT
    All that area containing 49 acres 3 roods 27 perches, being Section 37, Block III, Cromwell Survey District, and being all the land registered in Volume 115, folio 75 (Otago Registry).

    Authorizing the Acquisition of Land notwithstanding the Provisions as to Limitations of Area

    THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
    Pursuant to section forty of the Statutes Amendment Act, 1946, and all other powers him enabling, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the disposition to and the acquisition by Arthur Dawson Moir, of Millers Flat, Farmer, of the land described in the Schedule hereto, notwithstanding the provisions of section 107 of the Land Act, 1924.
    SCHEDULE
    OTAGO LAND DISTRICT
    Firstly, Section 46, Block VII, Benger Survey District, containing 35 acres, and being all the land comprised and described in Special Tenure Lease No. 201, registered in Register Book, Volume 228, folio 83, in the Land Registry Office at Dunedin.
    Secondly, Section 35s, Teviot Settlement, containing 810 acres, and being part of the land comprised and described in Renewable Lease No. 380s, registered in Register Book, Volume 206, folio 73, in the Land Registry Office at Dunedin.

    Authorizing the Laying-off of a Street off Avonside Drive (Galbraith Avenue Extension), in the City of Christchurch, of a Width less than 66 ft. but not less than 50 ft.

    At the Government Buildings at Wellington, this 26th day of November, 1946
    Present:
    THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
    Pursuant to the Municipal Corporations Act, 1933, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Christchurch City Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet but not less than fifty feet.
    SCHEDULE
    That proposed street in the Canterbury Land District, City of Christchurch, containing by admeasurement 2 roods 31·5 perches, more or less, being parts Lots 1, 2, and 3, D.P. 9299, and parts Lots 1 and 7, D.P. 12017, all being parts Rural Section 87. As the same is more particularly delineated on the plan marked P.W.D. 124441, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

    The Southern Side of Portion of Gorton Street and the Eastern Side of Portion of Hammond Street, in the Town District of Bulls, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

    ORDER IN COUNCIL
    At the Government Buildings at Wellington, this 26th day of November, 1946
    Present:
    THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
    Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Bulls Town Board on the tenth day of October, one thousand nine hundred and forty-six, viz.:-
    “The Bulls Town Board, being the local authority having control of the streets hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of Gorton Street and the eastern side of Hammond Street adjoining Section 16 of Block C, Deeds Plan 74,”;
    subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Gorton Street or the eastern side of the portion of Hammond Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
    SCHEDULE
    The southern side of all that portion of street situated in the Wellington Land District, Town District of Bulls, known as Gorton Street, fronting Section 16, Block C, Deeds Plan 74.
    The eastern side of all that portion of street situated in the said land district and town district, known as Hammond Street, fronting Section 16, Block C, Deeds Plan 74.
    As the same are more particularly delineated on the plan marked P.W.D. 124488, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
