At the Government House at Wellington, this 13th day of November, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the purpose for which it was acquired.

Matamata County Council required under the Town-planning Act, 1926, to prepare and submit to the Town-planning Board an Extra-urban Planning Scheme for the Tokoroa Township and Surrounding District

ORDER IN COUNCIL

At the Government House at Wellington, this 13th day of November, 1946

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the Matamata County Council is the responsible authority within the meaning of the Town-planning Act, 1926, of a certain rural area as defined in the said Act—namely, the Matamata County :

And whereas His Excellency the Governor-General is of opinion that settlement is taking place within a certain defined area within the rural area aforesaid—namely, the defined area described in the Schedule hereto, commonly known as the Township of Tokoroa and surrounding district—at such a rate that the preparation of an extra-urban planning scheme is deemed advisable in the public interest :

Now, therefore, in pursuance and exercise of the powers conferred upon him by section twenty-five of the Town-planning Act, 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby require the Matamata County Council to prepare and submit to the Town-planning Board before the thirty-first day of March, one thousand nine hundred and forty-seven, an extra-urban planning scheme in respect of the said area described in the Schedule hereto.

SCHEDULE

ALL that area comprising approximately 60,600 acres, in the Auckland Land District, situated in Blocks III, IV, VII, VIII, X, XI, XII, XIV, XV, XVI, Patetere South Survey District, Blocks III, V, and VII, Ngautuku Survey District, Blocks III and IV, Whakamaru Survey District, and Block I, Te Atiamuri Survey District, in the County of Matamata, included within the following boundaries : Commencing at the junction of the Puriri Road and the Waitoa-Wairakei (No. 809) Main Highway by a line proceeding northward generally to the northern boundary of part Lot 1 on D.P. 23021, deposited in the office of the Land Registrar at Auckland ; thence in a westerly and south-westerly direction generally by the northern and western boundaries of part Lot 1 on D.P. 23021 aforesaid, and the northern boundary of part Lot 4 on D.P. 17083, deposited as aforesaid, to the Taupo Totara Timber Company's railway-line ; thence by a right line to the eastern boundary of Lot 3, on D.P. 17083 aforesaid, of Section 44, Selwyn Estate ; thence in a northerly, south-westerly, and south-easterly direction by the eastern, north-western, and south-western boundaries of Lot 3 on D.P. 17083 aforesaid to a point on the Paraonui Road directly opposite the northernmost corner of Section 43B, Selwyn Estate ; thence by a right line across the Paraonui Road ; thence by the northern and north-western boundaries of Section 43B to the old Cambridge-Taupo Road ; thence by a right line across the old Cambridge-Taupo Road to the western boundary of the old Cambridge-Taupo Road ; thence in a south-easterly direction generally by the old Cambridge-Taupo Road to the northernmost corner of Part 1 on D.P. 22069, deposited as aforesaid ; thence by the north-western and south-western boundaries of Part 1 on D.P. 22069 aforesaid to the northernmost corner of Lot 46 on D.P. 13757, deposited as aforesaid, Maraetai Estate ; thence in a southerly direction generally by the western boundaries of Lot 46 and 45 on D.P. 13757 aforesaid to the northern boundary of Lot 44 on D.P. 17562, deposited as aforesaid ; thence in a westerly direction and then in a southerly direction generally by the northern boundaries of Lots 44 and 67, D.P. 17562 aforesaid, and the western boundary of Lot 67, D.P. 17562 aforesaid, to the Maraetai Road ; thence in a south-westerly direction generally by the Maraetai Road to the western boundary of Block X, Patetere South Survey District ; thence in a southerly direction by the western boundaries of Blocks X and XIV, Patetere South Survey District, to the northern boundary of D.P. 19831 and D.P. 19832, deposited as aforesaid ; thence in a south-easterly direction generally by the northern boundary of D.P. 19831 and D.P. 19832 aforesaid to the southernmost point of D.P. 18970, deposited as aforesaid, in Block XV, Patetere South Survey District ; thence by a right line in a south-easterly direction to the northernmost point of Whakamaru-Mangaiti West 5208 C 1 Block ; thence in a south-easterly and easterly direction generally by the southern boundaries of Lots 4 and 3, D.P. 22207, deposited as aforesaid, to the Matamata County boundaries ; thence in a northerly direction by the Matamata County boundary to the Uraura Trig. No. 807 ; thence in a northerly and north-westerly direction by the eastern boundaries of Lot 4, D.P. 26252, deposited as aforesaid, and the Education Reserve to the southern boundary of part Lot 3, D.P. 20030, deposited as aforesaid ; thence in an easterly, northerly, and north-westerly direction by the southern, eastern, and north-eastern boundaries of land on D.P. 20030 aforesaid to the eastern boundary of Lot 3, D.P. 26224, deposited as aforesaid ; thence in a northerly direction by the eastern boundaries of Lot 3, D.P. 26224 aforesaid, to the Puriri Road ; thence in a north-westerly direction generally by the Puriri Road to the point of commencement.

The North-eastern Side of Portion of Oxford Street, in the Borough of Richmond, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 13th day of November, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Richmond Borough Council on the thirteenth day of August, one thousand nine hundred and forty-six, viz. :—

“ The Richmond Borough Council, being the local authority having control of the streets in the Borough of Richmond, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of portion of Oxford Street fronting subdivision of part Lot 6 of Section 25, Waimea East, Block VII, Waimea Survey District, Certificate of Title 54/180 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Oxford Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE north-eastern side of all that portion of street situated in the Nelson Land District, Borough of Richmond, known as Oxford Street, fronting part Lot 6 of part Section 25, District of Waimea East. As the same is more particularly delineated on the plan marked P.W.D. 124215, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
