Varying the Determinations in respect of Portion (£65,000) of the Auckland Harbour Board's Loan of £200,000

ORDER IN COUNCIL
At the Government House at Wellington, this 16th day of October, 1946
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the twenty-fourth day of July, one thousand nine hundred and forty-six (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Auckland Harbour Board (hereinafter called the said local authority) of a loan of two hundred thousand pounds (£200,000) (hereinafter called the said loan), to be known as Harbour Loan, 1937, £1,000,000 -Fourth Issue, 1946, £200,000:
And whereas the authority conferred by the said Order in Council has not yet been exercised in respect of a portion thereof amounting to sixty-five thousand pounds (£65,000), and it is expedient to vary the determinations aforesaid in respect of this balance of sixty-five thousand pounds (£65,000) (hereinafter referred to as the said sum):
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said sum by prescribing as follows:—
(1) In lieu of a rate of interest not exceeding three pounds ten shillings (£3 10s.) per centum per annum, as specified in clause two of the said Order in Council, the rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds two shillings and sixpence (£3 2s. 6d.) per centum per annum.
(2) In lieu of making provision for the repayment of the said sum by establishing a sinking fund in respect thereof, as specified in clause three of the said Order in Council, the said local authority may raise the said sum or any portion thereof upon terms of making the same, together with interest thereon, repayable by equal aggregate annual or half-yearly instalments extending over the term of twenty (20) years, as specified in the Order in Council made on the twenty-fourth day of July, one thousand nine hundred and forty-six.

Member of Island Council of Niue appointed

PURSUANT to the authority vested in me by section sixty-five of the Cook Islands Act, 1915, and by an Order in Council of the twenty-first day of March, one thousand nine hundred and sixteen, providing for the constitution of Island Councils in the Cook Islands, I, Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby nominate and appoint Eneri to be a member of the Island Council of Niue, to hold office during my pleasure as from the ninth day of September, one thousand nine hundred and forty-six, vice Kalauta, appointment revoked.
As witness the hand of His Excellency the Governor-General of the Dominion of New Zealand, this 15th day of October, 1946.

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

Honorary Inspector of Scenic Reserves appointed

IN pursuance and exercise of the powers conferred by section four of the Scenery Preservation Act, 1908, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby appoint Alexander Thomas Newlands Simpson to be an Honorary Inspector under the said Act.
