The South-eastern Side of Portion of Paterson Street, in the Borough
of Green Island, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to the
Building-line

ORDER IN COUNCIL

At the Government House at Wellington, this 9th day of
October, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

P URSUANT to section one hundred and twenty-eight of the Public
Works Act, 1928, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Green Island Borough
Council on the sixth day of August, one thousand nine hundred
and forty-six, in so far as it affects the side and portion of street
described in the Schedule hereto, viz.:

“ That the Green Island Borough Council, being the local
authority having control of the streets in the Borough of Green
Island, by resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act, 1928, shall
not apply to that portion of Paterson Street abutting on
Allotments 25 and 26, Block D, Township of Kingston ”;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-eastern side
of the portion of Paterson Street (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-line of the
said portion of street.

SCHEDULE

THE south-eastern side of all that portion of street situated in the
Otago Land District, Borough of Green Island, known as Paterson
Street, fronting Lot 26 and part Lot 25, Block D, D.P. 346, Town-
ship of Kingston. As the same is more particularly delineated on
the plan marked P.W.D. 124072, deposited in the office of the
Minister of Works at Wellington, and thereon edged red.

P URSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said Dominion,

Devonport Borough Council on the twenty-first day of August,
one thousand nine hundred and forty-six, viz.:

“ That the Devonport Borough Council, being the local
authority having control of the streets in the Borough of
Devonport, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public Works
Act, 1928, shall not apply to the northern side of the portion
of Jubilee Avenue adjoining part of Allotment 13, Section 2,
Parish of Takapuna, comprised in Certificate of Title 554/250 ”;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the northern side of
the portion of Jubilee Avenue (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-line of the
said portion of street.

SCHEDULE

THE northern side of all that portion of street situated in the North
Auckland Land District, known as Jubilee Avenue, fronting Lot 36
and part Lot 35, Deeds Plan No. 16, being part Allotment 13 of
Section 2, Parish of Takapuna (Borough of Devonport). As the
same is more particularly delineated on the plan marked P.W.D.
124114, deposited in the office of the Minister of Works at
Wellington, and thereon coloured red.

P URSUANT to section one hundred and sixty-seven of the
Native Land Act, 1931, His Excellency the Governor-General,
acting by and with the advice and consent of the Executive Council,
doth hereby vary an Order in Council made on the fourth day of
April, one thousand nine hundred and thirty-two, and published in
the Gazette on the seventh day of April, one thousand nine hundred
and thirty-two, at page 735, and affecting Hauturu East B 2
Section 2A 1A and other blocks by excluding therefrom the lands
described in the Schedule hereto.

Appointment of New Trustee for the Otakeho Public Cemetery

P URSUANT to section four of the Cemeteries Act, 1908, I,
Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-
General of the Dominion of New Zealand, do hereby appoint

Murray McNeill-Adams

to be a trustee to have the maintenance and care of the cemetery
under the said Act known as the Otakeho Public Cemetery, in
conjunction with such of the other persons heretofore so appointed
as are still in office, and in place of

James Crawford Duff,

whose seat has become vacant by death.

As witness the hand of His Excellency the Governor-General,
this 1st day of October, 1946.
