Boundaries of City of Christchurch and County of Waimairi altered

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 18th day of September, 1946

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area be excluded from the County of Waimairi and included in the City of Christchurch:

And whereas a Commission appointed under the said section held inquiries and recommended that the said area be excluded from the County of Waimairi and included in the City of Christchurch:

And whereas it is deemed expedient to make the alteration of boundaries recommended by the said Commission:

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of October, one thousand nine hundred and forty-six, the area described in the Schedule hereto shall be excluded from the County of Waimairi and included in the City of Christchurch.

SCHEDULE

AREA EXCLUDED FROM THE COUNTY OF WAIMAIRI AND INCLUDED IN THE CITY OF CHRISTCHURCH

ALL that area of land in the Canterbury Land District, situated in Blocks VII and XI, Christchurch Survey District, and bounded by a line commencing at a point on the boundary of the City of Christchurch, such point being on the south-eastern side of Innes Road in line with the south-western side of McFadden’s Road, proceeding thence north-easterly along the city boundary to a point in line with the south-western side of Phillpot’s Road; thence north-westerly along the south-western side of Phillpot’s Road to the northern corner of Rural Section 781; thence south-westerly and south-easterly along the north-western and south-western boundaries of Rural Section 781 to a point on the north-western boundary of Rural Section 699; thence south-westerly along the north-western boundary of Rural Section 699 to and across McFadden’s Road to a point on the boundary of the City of Christchurch; thence south-easterly along that boundary to the point of commencement.

SCHEDULE

AREAS EXCLUDED FROM THE COUNTY OF WAIMAIRI AND INCLUDED IN THE CITY OF CHRISTCHURCH

ALL that area of land in the Canterbury Land District, situated in Block XI, Christchurch Survey District, and bounded by a line commencing at a point on the intersection of the southern side of Wairarapa Road and the eastern side of Idris Road, being a point on the boundary of the City of Christchurch, proceeding thence southerly along the eastern side of Idris Road to the left bank of the Wairarapa Stream; thence generally easterly along the left bank of that stream to the western boundary of the Hurunui-Christchurch Railway land; thence northerly along the western side of the said Hurunui-Christchurch Railway land to the southern side of Wairarapa Road, being a point on the boundary of the City of Christchurch; thence westerly along that boundary to the point of commencement.

Also all that area in the County of Waimairi, Canterbury Land District, bounded by a line commencing at a point on the existing boundary of the City of Christchurch, such point being the southernmost corner of Lot 19 on plan deposited in the Canterbury District Land Registry Office at Christchurch as No. 5160; thence proceeding in a north-westerly direction along the north-eastern side of Strowan Road to a point in line with the north-western side of Glandovey Road; thence to and by the north-western side of Glandovey Road aforesaid, to and across the railway reserve to a point on the western side of the said railway reserve; thence northerly along the western side of that railway reserve to the south-western side of Wairarapa Road, being a point on the existing boundary of the City of Christchurch; thence generally south-easterly along that boundary to the point of commencement.

At the Government Buildings at Wellington, this 18th day of September, 1946

Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Waimarino County Council stopping the portions of road described in the Schedule hereto.

Consenting to the Raising of Portion (£2,400) of the Birkenhead Borough Council’s Loan of £4,000 and prescribing the Conditions thereof

At the Government House at Wellington, this 11th day of September, 1946

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the twenty-fifth day of September, one thousand nine hundred and forty (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Birkenhead Borough Council (hereinafter called the said local authority) of the sum of four thousand pounds (£4,000) by a loan to be known as Sewerage Connections Loan, 1938 (hereinafter called the said loan):

And whereas the authority conferred by the said Order in Council has not been fully exercised:

And whereas the authority has lapsed in accordance with the provisions of clause seven thereof, and it is not now lawful or competent for the said local authority to raise the said loan, except in accordance with the provisions of a further Order in Council that may be issued pursuant to section eleven of the Local Government Loans Board Act, 1926 (hereinafter called the said Act):

And whereas it is expedient to authorize the said local authority to raise portion of the said loan amounting to two thousand four hundred pounds (£2,400) (hereinafter called the said sum) on the conditions hereinafter set out:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said sum up to the amount of two thousand four hundred pounds (£2,400), and in giving such consent doth hereby determine as follows:—

(1) The term for which the said sum or any part thereof may be raised shall not exceed seven (7) years.

(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds fifteen shillings (£3 15s.) per centum per annum.
