Vesting the Control of a Scenic Reserve in the Hutt County Council

B. C. FREYBERG, Governor-General

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908 (hereinafter referred to as the said Act), His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the scenic reserve described in the Schedule hereto (being land reserved under the said Act) in the Hutt County Council, subject to the conditions hereinafter contained, that is to say:—

  1. The period for which the control of the reserve is hereby vested shall be five years from the date hereof, unless the reservation is previously altered or revoked under the said Act.

  2. The said Council shall prepare a report each year ending on the thirty-first day of March, together with a statement of receipts and expenditure in connection with the said reserve. Such report and statement shall be sent to the Minister charged with the administration of the said Act as soon as possible after the close of the year.

  3. The said Council shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.


SCHEDULE

LOWRY BAY SCENIC RESERVE.—WELLINGTON LAND DISTRICT

ALL that area in the Hutt County containing by admeasurement 163 acres 1 rood 27·1 perches, more or less, being part of Lot 4 on D.P. 12030, and being parts of Sections 20, 21, 22, and 23, Harbour District, Block XVI, Belmont Survey District, subject, however, to two (2) pipe-line easements created by transfers numbered 216109 and 219497, Wellington Registry, and coloured blue on plan.

Also all that area in the Hutt County containing by admeasurement 2 acres 3 roods 19 perches, more or less, being Lot 36 on D.P. 1714, being part of Section 20, Harbour District, Block XVI, Belmont Survey District, and being the whole of the land comprised in Certificate of Title, Volume 404, folio 96 (Wellington Registry).

As the said lands are more particularly delineated on the plan marked L. and S. 4/542D, deposited in the Head Office of the Department of Lands and Survey, at Wellington, and thereon bordered red.

As witness the hand of His Excellency the Governor-General, this 31st day of July, 1946.

Vesting the Control of Lake Rotoiti Scenic Reserves in a Scenic Board

IN pursuance and exercise of the powers and authorities conferred upon him by sections eighteen, nineteen, and twenty of the Native Purposes Act, 1931, and section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserves described in the Schedule hereto (being land subject to the last-mentioned Act) for the period of five years from the date hereof (unless previously altered or revoked under that Act) in the undermentioned persons, namely,—

Heru Tamati,
Rongo Rogers,
Rangikauariro Taiatini Te Tikao,
Te Mapu te Kirikau,
Henare Kenati, and
The District Manager, Tourist Bureau, Rotorua, ex officio,

who are hereby constituted for that purpose a special Board by the name of the Lake Rotoiti Scenic Board (herein referred to as the Board), in trust for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say:—

  1. The first meeting of the Board shall be held on Monday, the second day of September, one thousand nine hundred and forty-six, at Otaremarae, Rotoiti, and thereafter the Board shall meet for the transaction of business on the first Monday in each month at the place aforesaid, or at such time or place as may from time to time be fixed by the Board.

  2. The Chairman shall have an original as well as a casting vote, and shall hold office until the election of his successor.

  3. Special meetings may be convened by the Chairman, provided that two days' notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  4. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.

  7. If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself, without reasonable cause, from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

  8. The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister charged with the administration of the Scenery Preservation Act, 1908, as soon as possible after each annual meeting.

  9. The Board shall control the said reserves in accordance with the provisions of the Scenery Preservation Act, 1908, and of the regulations made thereunder.

LAKE ROTOITI SCENIC RESERVES.—AUCKLAND LAND DISTRICT

(a) LAKE Rotoiti Scenic Reserves, as described in the Schedule to the Warrant published in Gazette of 1928, page 1090.

(b) Hongi's Track Reserves, as described in the Schedule to the Warrant published in Gazette of 1928, page 2928.

(c) Waione Block Reserves, as described in the Schedule to the Proclamation published in Gazette of 1931, page 1685.
