Land reserved under the Scenery Preservation Act, 1908

A PROCLAMATION

WHEREAS the Scenery Preservation Board, constituted pursuant to the Scenery Preservation Act, 1908 (hereinafter referred to as the said Act), has recommended that the land described in the Schedule hereto should be permanently reserved for scenic purposes, and it is expedient to give effect to such recommendation:

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the said Act, do hereby proclaim and declare that the land described in the Schedule hereto shall be a scenic reserve under the said Act, and subject to the provisions thereof.

SCHEDULE

AUCKLAND LAND DISTRICT

ALL that area containing by admeasurement 65 acres and 25 perches, more or less, Block IV, Horohoro Survey District, being Lot 1 on a plan deposited in the Land Registry Office at Auckland as No. 31278, and being portion of the blocks called Rotohokahoka D North No. 2B and 10, and being the whole of the land comprised in Certificate of Title, Volume 842, folio 281 (Auckland Registry).

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 10th day of July, 1946.

Authorizing the Gisborne Municipal Council to reclaim Land in the Waikanae Stream, Gisborne

ORDER IN COUNCIL

At the Government House at Wellington, this 10th day of July, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS it is provided by the one-hundred-and-sixty-eighth section of the Harbours Act, 1923 (hereinafter called the said Act), that the Governor-General may from time to time, by Order in Council, authorize any local authority or Harbour Board to reclaim from the sea areas, not exceeding five acres in extent, in any case where he considers that the reclamation will not affect navigation and is for the benefit of the public:

And whereas the Gisborne Municipal Council (hereinafter called the Council) is desirous of reclaiming from the sea certain land in the Waikanae Stream near Gisborne, and the said reclamation is of such a nature as aforesaid, and the Council has applied to the Governor-General in Council for an order authorizing the execution of the said harbour-works:

And whereas it has been made to appear to the Governor-General in Council that the proposed work will not be or tend to the injury of navigation and is for the benefit of the public:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize and empower the Council to reclaim from the sea in the Waikanae Stream near Gisborne the land marked “proposed reclamation,” coloured pink on plan marked M.D. 8499 and deposited in the office of the Marine Department at Wellington, such reclamation to be carried out and constructed in accordance with plan M.D. 8499, subject to the provisions of the said Act.

Domain Board appointed to have Control of the Okarito Domain

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

James Thompson,
Laurance Millard,
John Matthew Shortell,
Thomas Casey,
John Lewis Sweeney (jun.),
Nancy Helene Thompson, and
James Donovan

to be the Okarito Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Saturday, the tenth day of August, one thousand nine hundred and forty-six, at two o'clock p.m., as the time when, and the Schoolhouse, Okarito, as the place where, the first meeting of the Board shall be held.

OKARITO DOMAIN.—WESTLAND LAND DISTRICT

RESERVE 1007, Block XI, Okarito Survey District: Area, 4 acres 3 roods 21 perches, more or less.

Also all that area containing by admeasurement 159 acres 2 roods, more or less, being Reserve No. 201 and part of Reserve No. 204, together with land known as the Okarito Racecourse, Okarito Survey District: Bounded towards the north-west by a road reserve 100 links wide along the shore of the Okarito Lagoon, 5250 links, more or less; towards the east generally by the Okarito Lagoon; and towards the south and south-west by the other portion of Reserve No. 204, 4300 and 800 links, more or less. As the same is delineated on the plan marked L. 1106, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured pink.

Revoking the Reservation over a Reserve in Block VII Paritutu Survey District, Taranaki Land District

ORDER IN COUNCIL

At the Government House at Wellington, this 10th day of July, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for a pound-site over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and with the consent of the licensee, doth hereby revoke the Orders in Council dated the twelfth day of June, one thousand nine hundred and thirty-six, and published in the New Zealand Gazette No. 40 of the eighteenth day of the same month, at page 1160, and dated the fifth day of August, one thousand nine hundred and forty-two, and published in the New Zealand Gazette No. 78 of the twentieth day of the same month, at page 2068, authorizing Donald William Hudspith, of Ohaeawai, Farmer, to use water for the purpose of generating electricity.
