Validating Valuation List made by Edendale Town Board

ORDER IN COUNCIL
At the Government House at Wellington, this 10th day of July, 1946
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the triennial valuation list for the Town District of Edendale was prepared and transmitted to the Edendale Town Board (hereinafter referred to as the said Board), pursuant to section eight of the Rating Act, 1925:

And whereas the said Board caused the valuation list so sent to it to be deposited for public inspection and publicly notified that such list was open for inspection and of the place where it was deposited and of the manner in which objections thereto should be made:

And whereas by reason of circumstances beyond the control of the said Board the public notification aforesaid was not published on two occasions within the period specified by section fifteen of the said Act:

And whereas it is desirable to validate the proceedings in connection with the said valuation list:

Now, therefore, in pursuance and exercise of the powers conferred on him by section ninety-nine of the said Act, and so that the intent and purpose of the said Act may have effect, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that the proceedings in connection with the said valuation list shall be valid to all intents and purposes as though the said Board had once in each week during the prescribed period given the public notification required by the said section fifteen of the said Act; and doth accordingly declare that the said valuation list shall not be called in question by reason only of the irregularity aforesaid.

Cancelling the Appointment of the Chairman and Deputy Chairman of the Main Highways Board, appointing another Chairman and another Deputy Chairman, and appointing Members of the said Board

WHEREAS by a Warrant dated the twenty-ninth day of April, one thousand nine hundred and forty, and published in the New Zealand Gazette No. 41 of the ninth day of May of the same year, William Langston Newnham, Esquire, of Wellington, the second Assistant Engineer-in-Chief of the Public Works Department, was appointed to be a member of the Main Highways Board in terms of subsection three, clause (a), of section five of the Main Highways Act, 1922:

And whereas by Warrant dated the eleventh day of March, one thousand nine hundred and forty-one, and published in the New Zealand Gazette No. 23 of the same month and year, the said William Langston Newnham was appointed to be Chairman of the said Board:

And whereas by Warrant dated the seventh day of June, one thousand nine hundred and forty-five, and published in the New Zealand Gazette No. 41 of the fourteenth day of the same month and year, Thomas George Gordon Beck, Esquire, of Wellington, then Acting Assistant Engineer-in-Chief of the Public Works Department, was appointed to be a member of the Main Highways Board in terms of subsection three, clause (a), of section five of the Main Highways Act, 1922:

And whereas the said William Langston Newnham and Thomas George Gordon Beck have tendered their resignations from the Main Highways Board, and it is considered expedient to accept such resignations:

And whereas by a Warrant dated the thirty-first day of July, one thousand nine hundred and forty-five, and published in New Zealand Gazette No. 52 of the ninth day of August of the same year, Fritz Langbein, Esquire, of Wellington, then Inspecting Engineer of the Public Works Department, was appointed to be an acting member of the Main Highways Board in terms of subsection five of section five of the Main Highways Act, 1922:

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, acting in pursuance and exercise of the powers and authorities conferred upon me by the Main Highways Act, 1922, and of all other powers and authorities enabling me in this behalf, do hereby accept the resignations of the said William Langston Newnham and Thomas George Gordon Beck as members and Chairman and Deputy Chairman of the Main Highways Board, and I do hereby cancel as from the date hereof the appointment of William Langston Newnham and Thomas George Gordon Beck as members and Chairman and Deputy Chairman respectively of the said Board:

And, in further pursuance and exercise of the said powers and authorities, I do hereby appoint as from the date hereof

Fritz Langbein, Esquire, of Wellington, Acting Engineer-in-Chief of the Public Works Department,

to be a member and Chairman of the Main Highways Board; and

Reginald Trevor Smith, Esquire, of Wellington, Acting Assistant Engineer-in-Chief of the Public Works Department,

to be a member and Deputy Chairman of the Main Highways Board in terms of subsection three, clause (a), of section five of the Main Highways Act, 1922.

As witness the hand of His Excellency the Governor-General, this 9th day of July, 1946.
