Price Order No. 569 (Amending Price Order No. 497) (Main Crop Potatoes)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following amending Price Order:
- This Order may be cited as Price Order No. 569, and shall be read together with and deemed part of Price Order No. 497† (hereinafter referred to as the principal Order).
- This Order shall come into force on the 1st day of July, 1946.
APPLICATION OF THIS ORDER
- (1) This Order applies with respect to all potatoes which, being subject to the principal Order, are sold by a grower for delivery at any time after the commencement of this Order and on or before the 30th day of November, 1946.
(2) For the purposes of this Order no potatoes sold on the basis of f.o.b.s.i. or f.o.r.s.i. shall be deemed to be delivered to the purchaser after the commencement of this Order if-
(a) In the case of sales f.o.b.s.i. the vessel on which the potatoes are laden leaves the port of shipment at any time before midnight on the 30th day of June, 1946; or
(b) In the case of sales f.o.r.s.i. the trucks on which the potatoes are laden leave the grower's station at any time before midnight of the said date.
(3) Except as provided in the last preceding subclause, potatoes sold f.o.b.s.i. or f.o.r.s.i. shall be deemed to be delivered to the purchaser after the commencement of this Order notwithstanding that they may have been actually laden on board any vessel or trucks before the commencement of this Order.
MODIFICATION OF PRINCIPAL ORDER WITH RESPECT TO POTATOES THAT ARE SUBJECT TO THIS ORDER
- (1) Notwithstanding anything to the contrary in the principal Order the maximum price that may be charged by any grower for any potatoes to which this Order applies shall be determined in accordance with the following scale, namely:-
(a) For Sutton's Supreme or King Edward potatoes grown in the South Island and sold for delivery-
Maximum Price per Ton f.o.b.s.i. a Port in the South Island. (f.a.q.). (Under-grade). From 1st July, to 31st July, 1946 £ s. d. £ s. d. (both days inclusive) .. 8 15 0 7 15 0 From August, 1946, to November, 1946: Pending the issue of an amending Price Order, and subject to the provisions of any such Order, the prices as at 31st July, 1946, shall also apply with respect to potatoes sold for delivery in the months of August to November.
(b) For any other variety of potatoes grown in the South Island and sold for delivery-
Maximum Price per Ton f.o.b.s.i. a Port in the South Island. (f.a.q.). (Under-grade). From 1st July to 31st July, 1946 £ s. d. £ s. d. (both days inclusive) .. 8 5 0 7 5 0 From August, 1946, to November, 1946: Pending the issue of an amending Price Order, and subject to the provisions of any such Order, the prices as at 31st July, 1946, shall also apply with respect to potatoes sold for delivery in the months of August to November.
(c) For potatoes (other than “tagged” potatoes) grown in the North Island and sold for delivery-
Maximum Price per Ton f.o.r.s.i. the Grower's Station. (f.a.q.). (Under-grade). From 1st July to 31st July, 1946 £ s. d. £ s. d. (both days inclusive) .. 10 10 0 9 10 0 From August, 1946, to November, 1946: Pending the issue of an amending Price Order, and subject to the provisions of any such Order, the prices as at 31st July, 1946, shall also apply with respect to potatoes sold for delivery in the months of August to November.
(2) With respect to “tagged” potatoes the maximum price that may be charged by the grower shall be the price fixed in accordance with paragraph (c) of the last preceding subclause for f.a.q. potatoes, but may exceed such price by an amount not exceeding 10s. a ton in any case.

Price Order No. 570 (Baking-powder manufactured by T. J. Edmonds, Ltd.)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:-
PRELIMINARY
- This Order may be cited as Price Order No. 570, and shall come into force on the 1st day of July, 1946.
- (1) Price Order No. 24† is hereby revoked.
(2) The revocation of the said Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.
APPLICATION OF THIS ORDER
- This Order applies only with respect to baking and cake powders manufactured by T. J. Edmonds, Ltd., and marketed under the trade name of “Acto” or “Sure to Rise.”
FIXING MAXIMUM PRICES OF BAKING AND CAKE POWDERS TO WHICH THIS ORDER APPLIES
Manufacturer's Prices
- (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by the manufacturer for any baking or cake powders to which this Order applies when sold to a wholesaler shall be-

(2) The maximum prices fixed by the foregoing provisions of this clause shall be reduced by a trade discount of 10 per cent. thereof with respect to “Acto” baking and cake powders or 7½ per cent. thereof with respect to “Sure to Rise” baking and cake powders, and in each case the price so calculated shall be further reduced by a discount of 2½ per cent. thereof where payment is made on or before the 20th day of the month following the month in which the sale is made to the wholesaler.
(3) The maximum prices fixed by the foregoing provisions of this clause are fixed as for delivery (whether made to a wholesaler or to any person on behalf of a wholesaler) by the consignor on the same terms and conditions as to payment of charges on account of sea freight, marine insurance, landing, cartage, and rail freight as existed between manufacturer and wholesaler with respect to “Acto” baking and cake powders prior to the coming into force of this Order.
Wholesalers' Prices
- (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any wholesaler for any baking or cake powders to which this Order applies shall be-

(2) The maximum prices fixed by the foregoing provisions of this clause are fixed subject to the same quantity stipulations, terms, and conditions with respect to cash and quantity discounts and with respect to payment of charges on account of sea freight, marine insurance, landing, cartage, and rail freight as existed between wholesaler and retailer with respect to “Acto” baking and cake powders prior to the coming into force of this Order, except that the quantity discount on “Sure to Rise” baking and cake powders shall be 3½ per cent.
(3) The provisions of subclause (2) of this clause shall apply with respect to assorted lots as well as to other lots.
