The Eastern Side of Portion of Public Road, in the County of Waimea,
exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 22nd day of
May, 1946

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL

P URSUANT to the Public Works Act, 1928, His Excellency the
Administrator of the Government of the Dominion of New
Zealand, acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the following
resolution passed by the Waimea County Council on the eighth day
of March, one thousand nine hundred and forty-six, viz.:

"The Waimea County Council, being the local authority
having control of the roads in the County of Waimea, by
resolution declares that the provision of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not apply
to the eastern side of public road fronting subdivision of part
Section 15, Motueka District, Block III, Motueka Survey
District, and contained in the Certificate of Title 62/221";

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the eastern side of the
portion of public road (described in the Schedule hereto) within a
distance of thirty-five feet from the centre-line of the said portion
of road.

SCHEDULE

THE eastern side of all that portion of public road situated in the
Nelson Land District, County of Waimea, fronting part Section 15,
District of Motueka. As the same is more particularly delineated
on the plan marked P.W.D. 123271, deposited in the office of the
Minister of Works at Wellington, and thereon coloured red.

P URSUANT to the Public Works Act, 1928, His Excellency the
Administrator of the Government of the Dominion of New
Zealand, acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the following

day of January, one thousand nine hundred and forty-six, viz.:

"The Waimea County Council, being the local authority
having control of the roads in the Waimea County, by resolution
declares that the provision of section one hundred and twenty-
eight of the Public Works Act, 1928, shall not apply to the
roads through Sections 45, 46, 47, and 48, Block XI, marked
AB and CD respectively, and the road through Section 4 and
part Section 3, Pigeon Valley District, Block XII, Wai-iti
Survey District, marked EF, and contained in the Certificates
of Title 19/211, 19/212, 72/97";

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the portions of the
public roads (described in the Schedule hereto) within a distance of
thirty-five feet from the centre-lines of the said portions of roads.

SCHEDULE

ALL that portion of public road situated in the Nelson Land District,
County of Waimea, fronting Sections 45, 46, and 47, Block XI
Wai-iti Survey District.

Also all that portion of public road situated in the said land
district and county fronting Section 48, Block XI, Wai-iti Survey
District.

Also all that portion of public road situated in the said land
district and county fronting Section 4, and parts Section 3, District
of Pigeon Valley.

As the same are more particularly delineated on the plan
marked P.W.D. 123118, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.

Revoking Order in Council prohibiting Alienation of Native Land

P URSUANT to section four hundred and forty-two of the Native
Land Act, 1931, His Excellency the Administrator of the
Government, acting by and with the advice and consent of the
Executive Council, doth hereby revoke the Order in Council made on
the twenty-seventh day of February, one thousand nine hundred
and thirty-five, and published in the Gazette on the seventh day of
March, one thousand nine hundred and thirty-five, at page 626,
and affecting Mangaorapa 2B 1A and Mangaorapa 2B 1B Blocks.

Exempting Land (State Coal Reserve) in the Westland Land District
from the Operation of Part III of the Coal-mines Act, 1925

I N pursuance and exercise of the powers and authorities conferred
upon me by subsection two of section one hundred and seventy-
one of the Coal-mines Act, 1925, and of all other powers and
authorities enabling me in this behalf, I, Sir Michael Myers, the
Administrator of the Government of the Dominion of New Zealand,
do hereby declare that the land described in the Schedule hereto
shall be exempt from the operation of Part III of the Coal-mines
Act, 1925, and do hereby further declare that this notice shall
take effect as from the date of the publication hereof in the New
Zealand Gazette.

SCHEDULE

ALL that parcel of land containing 24 perches, more or less, being
Lot 19, Block III, Deposited Plan 148 (Town of Dunollie),
reserving and excepting to the Bank of New South Wales, its
successors and assigns, the right to the minerals beneath the surface
of the above-described lot, with full power and authority to work,
hew, and get the said minerals by underground workings without
entering upon or in any manner affecting or exercising any rights
or powers whatsoever in or over the surface of the said land, and
being part of the land comprised in Certificate of Title, Volume 45,
folio 83 (Westland Land Registry).

As witness the hand of His Excellency the Administrator of
the Government, this 20th day of May, 1946.

Appointing a Member of the Wellington Harbour Board

I N pursuance and exercise of the powers and authorities conferred
upon me by the Harbours Act, 1923, I, Sir Michael Myers, the
Administrator of the Government of the Dominion of New
Zealand, do hereby appoint

Alfred Humphreys

to be a member of the Wellington Harbour Board as a representative
of the electors of the counties of Manawatu, Oroua, Horowhenua,
Pohangina, Kairanga, and Kiwitea, and of the boroughs of
Palmerston North, Feilding, Foxton, Shannon, Otaki, and Levin,
in place of Meldrum Alfred Eliott, deceased.

As witness the hand of His Excellency the Administrator of
the Government of the Dominion of New Zealand, this
16th day of May, 1946.

Order under Section 6 of the Visiting Forces Act, 1939

P URSUANT to subsection five of section six of the Visiting
Forces Act, 1939, I, Sir Michael Myers, the Administrator
of the Government of the Dominion of New Zealand, do hereby
make the following order:β€”

  1. The Air Forces of New Zealand serving as part of the British
    Commonwealth Occupation Force are hereby declared for the
    purpose of the above-mentioned section six to be serving together
    and acting in combination with the military and air forces of His
    Majesty raised in the United Kingdom.

  2. The Air Forces of New Zealand serving as part of the British
    Commonwealth Occupation Force are hereby declared for the
    purposes of the above-mentioned section six to be serving together
    with and acting in combination with the military and air forces
    of His Majesty raised in the Commonwealth of Australia.

As witness the hand of His Excellency the Administrator of
the Government of New Zealand, this 20th day of May,
1946.
