CROWN LANDS NOTICE
Education Reserves in Hawke’s Bay Land District for Lease
District Lands and Survey Office,
Napier, 7th May, 1946.
NOTICE is hereby given that the undermentioned education reserves are open for lease under the provisions of the Education Reserves Act, 1928, and the Public Bodies’ Leases Act, 1908; and applications will be received at the District Lands and Survey Office, Napier, up to 4 o’clock p.m. on Monday, 8th July, 1946.
Applicants should appear personally for examination at the District Lands and Survey Office, Napier, on Thursday, 11th July, 1946, at 10 o’clock a.m., but if any applicant is unable to attend he may be examined by any other Land Board or by any Commissioner of Crown Lands.
The ballot will be held immediately upon conclusion of the examination of applicants, and the successful applicant is required to pay immediately at conclusion of ballot the first half-year’s rent, broken-period rent, and lease fee.

STATE FOREST SERVICE NOTICE
Milling-logs for Sale by Public Tender
State Forest Service,
Auckland, 7th May, 1946.
NOTICE is hereby given that written tenders for the purchase of saw-logs, as more particularly described in the Schedule hereto, will close at the office of the State Forest Service, Auckland, at 4 p.m. on Monday, the 1st day of July, 1946.
Tenderers will be required to offer a price per cubic foot for each class of each species specified in the Schedule.
SCHEDULE
AUCKLAND CONSERVANCY.—AUCKLAND LAND DISTRICT
SAW-LOGS, not including logs required for plywood manufacture or other uses as determined by the Commissioner of State Forests (hereinafter referred to as the Commissioner), that are delivered for the purposes of this sale by the Crown from State Forest No. 96. The delivery of logs will be commenced on the 4th day of November, 1946, or at such earlier date as may be mutually agreed upon. Logs will be delivered to a mill-site situated in State Forest in Block XIV, Ranginui Survey District, and to be leased from the Crown, and will amount altogether to not less than 184,000 cubic feet and not more than 253,000 cubic feet. Logs will be subdivided into classes, and definitions of these classes and upset prices are as follows :—
Rimu, Miro, Kahikatea, and Totara
Class I.—Logs over 9 ft. 6 in. centre girth outside bark measurement with not more than 25 per cent. of gross volume allowed as deduction for defects.
Class II.—Logs between 6 ft. 6 in. and 9 ft. 6 in. centre girth outside bark measurement with not more than 25 per cent. of gross volume allowed as deduction for defect, and all logs over 9 ft. 6 in. centre girth outside bark measurement with over 25 per cent. of gross volume allowed as deduction for defect.
Class III.—Logs up to 6 ft. 6 in. centre girth outside bark measurement and logs between 6 ft. 6 in. and 9 ft. 6 in. centre girth outside bark measurement with over 25 per cent. of gross volume allowed as deduction for defect.

Class III.—Logs between 4 ft. and 6 ft. 6 in. centre girth outside bark measurement with not more than 25 per cent. of gross volume allowed as deduction for defect, and all logs 6 ft. 6 in. to 9 ft. 6 in. centre girth outside bark measurement with over 25 per cent. of gross volume allowed as deduction for defect.
Class IV.—Logs up to 4 ft. centre girth outside bark measurement and logs between 4 ft. and 6 ft. 6 in. centre girth outside bark measurement with over 25 per cent. of gross volume allowed as deduction for defect.

The Commissioner reserves the right to adjust these prices consequent upon any price adjustment of timber being made pursuant to the Price Stabilization Emergency Regulations 1939.
TERM OF AGREEMENT
Four years, with the right to purchase for successive two-year periods thereafter during a period of twelve years a similar quantity of forest-produce in the form either of logs or of trees, that is to say: Upon the expiry of the four-year term during which the Commissioner undertakes to supply logs the purchaser shall have the right to purchase for successive two-year periods during the subsequent twelve-year period aforesaid, at such prices as the Commissioner may determine, forest-produce in the form either of logs or of trees as the Commissioner may decide, not less in quantity than the biennial average quantity purchased during the said four-year term. The prices to be charged in respect of the subsequent sales shall be determined as far as possible to make them conform to the then current values of sawn produce.
Deposit and Terms of Payment
As a guarantee of good faith a marked or banker’s cheque to yield the sum of £1,000 (one thousand pounds) must accompany the tender, and shall be returned if the tender is not accepted. In the case of the purchaser the sum yielded by the cheque shall be deposited in the Receiver-General’s Deposit Account as security against default in payment for the logs purchased as herein provided, and the interest thereon shall be paid to the purchaser from time to time. The said sum may at the conclusion of milling-operations be returned to the purchaser in toto, or be used in payment for the last month’s supply of logs, any surplus being returned to the purchaser.
In addition, the purchaser shall, within 28 (twenty-eight) days of notification of the acceptance of his tender, deposit with the Conservator of Forests, Rotorua (hereinafter referred to as the Conservator), further securities to the value of £1,000 (one thousand pounds), to be held against default in payment for the forest-produce purchased as herein provided, or failure to comply with the terms and conditions hereunder or incorporated in a sale agreement in writing to be drawn up between the Commissioner and the purchaser, or any subsequent license or agreement. Should payment be made regularly, and should the said terms and conditions be faithfully observed, the securities will be returned to the purchaser at the conclusion of milling-operations. The said securities may be by marked or banker’s cheque, inscribed stock, Government bonds, or in other form acceptable to the Commissioner, and (if in cash) will be invested and the interest paid to the purchaser as aforesaid.
