Amending Foreshore License.—Barge Landing, Mangawhare, Kaipara Harbour.—Peter Sunde

ORDER IN COUNCIL
At the Government House at Wellington, this 1st day of May, 1946
Present :
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
PURSUANT to the Harbours Act, 1923, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby amend the Order in Council dated the nineteenth day of December, one thousand nine hundred and forty-five, and published in the Gazette of the tenth day of the following month at page 5, licensing Peter Sunde to occupy a part of the foreshore at Mangawhare, Kaipara Harbour, as a site for a barge landing, by revoking clause two in the Schedule to the hereinbefore-recited Order in Council and substituting the following clause :—
“2. The annual sum payable by the licensee shall be two pounds ten shillings (£2 10s.).”

Cancelling the Appointment of the Chairman of the Soil Conservation and Rivers Control Council and appointing a Chairman of the said Council

IN pursuance and exercise of the powers vested in me by section four of the Soil Conservation and Rivers Control Act, 1941, I, Sir Michael Myers, the Administrator of the Government of the Dominion of New Zealand, do hereby cancel as from the date hereof the appointment of William Langston Newnham, Esquire, as the Chairman of the Soil Conservation and Rivers Control Council, and do hereby appoint as from the date hereof Thomas George Gordon Beck, Esquire, Assistant Engineer-in-Chief of the Public Works Department, to be the Chairman of the said Council.
As witness the hand of His Excellency the Administrator of the Government, this 7th day of May, 1946.

Cancelling a Notice in Respect of Land in the Borough of Hokitika

WHEREAS by notice dated the twenty-sixth day of September, one thousand nine hundred and forty-five, and published in the New Zealand Gazette on the fourth day of October, one thousand nine hundred and forty-five, at page 1230, the exemption of certain lands in the Borough of Hokitika from mining, or from any specified mining purpose, or from the operation of the Mining Act, 1898, or from any specified provisions of that Act was revoked :
And whereas the notice revoking the said exemption of the said lands is incorrect and should be cancelled :
Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred on me by section seven of the Mining Act, 1926, do hereby wholly cancel the notice dated the twenty-sixth day of September, one thousand nine hundred and forty-five.
As witness the hand of His Excellency the Governor-General, this 11th day of April, 1946.

Land permanently reserved in the Otago Land District for Public-utility Purposes

WHEREAS by the three-hundred-and-fifty-ninth section of the Land Act, 1924, it is enacted that the Governor-General may from time to time set apart temporarily as reserves, notwithstanding that the same may be then held under pastoral license, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned :
And whereas by the three-hundred-and-sixtieth section of the said Act it is provided that land temporarily reserved under the said three-hundred-and-fifty-ninth section may, at the expiration of one month, but not later than six months, after the publication in the Gazette of notice of such temporary reservation, be permanently reserved, and that notice of such permanent reservation shall be published in the Gazette :
And whereas the land described in the Schedule hereto was by the Warrant dated the eleventh day of March, one thousand nine hundred and forty-six, and published in the Gazette of the fourteenth day of that month, temporarily reserved under the authority of the said Act for public-utility purposes :
Now, therefore, I, Sir Michael Myers, the Administrator of the Government of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby permanently reserve the land described in the Schedule hereto for public-utility purposes, for which purpose the said land was so temporarily reserved as aforesaid.
SCHEDULE
OTAGO LAND DISTRICT
ALL that area situated in the Borough of Oamaru, containing by admeasurement 2·74 perches, more or less, being part Section 8, Block XCV, Town of Oamaru: Bounded towards the north by part Section 8, 155·13 links; towards the east by Section 9, 22·35 links; and towards the south by Section 10, 153·51 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 9/3434D, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red (S.O.P. 9487).

Vesting the Control of Scenic Reserves in the Hae Hae Te Moana Scenic Board

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Administrator of the Government of the Dominion of New Zealand doth hereby vest the control of the reserves described in the Schedule hereto (being land reserved under the said Act), for the period of five years from the date hereof (unless previously altered or revoked under the said Act), in the undermentioned persons, namely,—
John Studholme Barker,
Robin Paul Harper,
Charles William Lynn,
Godfrey David Burrows, and
Allan Marshall,
who are hereby constituted for that purpose a special Board by the name of the Hae Hae Te Moana Scenic Board (herein referred to as the Board), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say :—

The first meeting of the Board shall be held on Saturday, the fourth day of May, one thousand nine hundred and forty-six, at eight o’clock p.m., at the Schoolhouse, Four Peaks, and thereafter the Board shall meet for the transaction of business on the first Saturday in each quarter at the time and place aforesaid, or at such other time or place as may from time to time be fixed by the Board.

The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

Special meetings may be convened by the Chairman, provided that two days’ notice of such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman for such meeting.

If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister in Charge of Scenery Preservation as soon as possible after each annual meeting.

The Board shall control the said reserves in accordance with the provisions of the said Act and of the regulations made thereunder.

RESERVES 3883 and 4254, Block XV, Four Peaks Survey District: Area, 186 acres 2 roods, more or less.
