Consenting to the Raising of a Loan of £15,000 by the Timaru Borough Council and prescribing the Conditions thereof

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 3rd day of April, 1946
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
WHEREAS the Timaru Borough Council (hereinafter called the said local authority), being desirous of raising a loan of fifteen thousand pounds (£15,000), to be known as Flood Damage Loan, 1945 (hereinafter called the said loan), for the purpose of effecting repairs to the borough pipe-line damaged by flood, has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of fifteen thousand pounds (£15,000), and in giving such consent doth hereby determine as follows:—
(1) The term for which the said loan or any part thereof may be raised shall not exceed twenty (20) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds ten shillings (£3 10s.) per centum per annum.
(3) The said loan shall be repaid by equal annual instalments of principal of not less than seven hundred and fifty pounds (£750), each extending over the term of the loan as determined in (1) above.
(4) The payment of interest and principal in respect of the said loan shall be made in New Zealand.
(5) No amount payable either as interest or as principal in respect of the said loan shall be paid out of loan-money.
(6) The rate payable for brokerage, underwriting, and pro-curation fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.
(7) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Varying the Determinations in respect of the Pahiatua Borough Council's Loan of £3,500

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
WHEREAS by Order in Council made on the twenty-first day of June, one thousand nine hundred and forty-four, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Pahiatua Borough Council (hereinafter called the said local authority) of a loan of three thousand five hundred pounds (£3,500), to be known as Foot-paths, Kerbing, and Borough Improvements Loan, 1944 (hereinafter called the said loan):
And whereas the said loan has not yet been fully raised, and it is expedient to extend the term, as specified in clause six of the said Order in Council, within which the balance of the said loan or any portion thereof may be raised:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and con-sent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that no moneys shall be borrowed under the consent contained in the said Order in Council after the expiration of four (4) years from the date thereof.

IN pursuance and exercise of the powers and authorities con-ferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the purpose for which it was acquired.

APPROXIMATE area of the piece of land directed to be sold: 1 rood 4·9 perches.
Being Allotment 262 and part Allotment 263, Town of Richmond.
Situated in Block I, Awa-o-te-atua Survey District (Auckland R.D.). (S.O. 32906.)
In the Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 123033, deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.

IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was taken.

Being part Railway land comprised in Proc. 750.
Situated in Block XIV, Komakorau Survey District, Waikato County.

IN pursuance and exercise of the powers conferred upon him by the Soil Conservation and Rivers Control Act, 1941, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint the twenty-second day of June, one thousand nine hundred and forty-six, as the date on which shall be held the first election of representatives of the constituent districts in the Hauraki Catchment District, being a catchment district duly constituted by Order in Council dated the thirteenth day of February, one thousand nine hundred and forty-six, and published in the New Zealand Gazette No. 9 of the fourteenth day of the same month.
