Exempting Crown Land from the Provisions of the Mining Act, 1926

WHEREAS by section twenty of the Mining Act, 1926, it is, inter alia, enacted that the Governor-General may from time to time, by notice in the Gazette, exempt any Crown lands from mining, or from any specified mining purpose, or from that Act, or any specified provisions of that Act, and that the lands to which any such notice relates shall be specified therein by words of particular description:

And whereas it is desirable that the Crown land specified in the Schedule hereto should be exempted from the provisions of the Mining Act, 1926, and its amendments, subject to existing registered mining privileges:

Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on me by section twenty of the Mining Act, 1926, and of all other powers and authorities in anywise enabling me in that behalf, do hereby exempt the land particularly described in the Schedule hereto from the provisions of the Mining Act, 1926, subject to existing registered mining privileges, and do also hereby declare that such exemption shall take effect from the date of the publication of this notice in the Gazette.

WESTLAND LAND DISTRICT.—WESTLAND MINING DISTRICT

ALL that area in the Grey County containing by admeasurement 27,100 acres, more or less, being Sections 4, 6, 2700, 2701, 3154A, 3590, 3826, 3098 to 3102, and part 2699; Sections 1 to 6, 10, 11, 13 to 17, 19 to 23, 25 to 29, and 33 to 43, Town of Orwell Creek; Crown land (including creeks); part Reserves 1596, 1597, 1606, 1694, 1738 (provisional State forest); part Reserves 1596, 1597, 1606, 1694, 1738 (permanent State forest); and unnumbered gravel reserves along the Ahaura-Kopara Road; situated in Blocks XIII, XIV, and XV, Mawheraiti Survey District, and Blocks I, II, III, IV, VI, VII, VIII, and XII, Ahaura Survey District, and bounded as follows: Commencing at the northernmost corner of Section 2375, Block XII, Ahaura Survey District, and proceeding in a south-westerly direction along the north-western boundary of the said Section 2375 and that boundary produced to the north-eastern side of the Ahaura-Kopara Road; thence generally in a south-westerly direction along the north-western side of that road to its terminal; thence generally in a south-easterly direction along the terminal of that road and along the south-western boundary of Section 5, Square 121, to the northernmost corner of Section 2, Block III, Ahaura Survey District; thence generally in a south-westerly direction along the north-western boundary of that section, the abutment of a road, and that line produced to the left bank of the Waipuna Creek; thence generally in a southerly direction along the left bank of that creek to a point in line with the south-western boundary of Section 2; thence generally in a north-easterly direction, across the Waipuna Creek, and along the abutment of a road to and along the south-eastern boundary of the said Section 2; thence generally in an easterly direction along the southern boundary of Section 3, Block III, Ahaura Survey District, to and along the south-western boundary of Section 5, Square 121, to the north-western corner of Section 10, Block IV, Ahaura Survey District; thence generally in a southerly direction along the western boundary of Section 10; thence south-easterly along the south-western boundary of Section 9, the abutment of a road, and again south-easterly along the south-western boundaries of Sections 8 and 7; thence north-easterly along the south-eastern boundary of Section 7; thence in a south-easterly and north-easterly direction by the south-western and south-eastern boundaries respectively of Section 6 to the south-western boundary of Section 5, Square 121; thence generally in a south-easterly, easterly, and northerly direction along the south-western, southern, and eastern boundaries of Section 5, Square 121, to the south-western corner of Section 656; thence generally in an easterly direction along the southern boundary of that section, across the Clarke Track, and again along the southern boundary of that section to the westernmost corner of Section 4; thence generally in a south-easterly and north-easterly direction along the south-western and south-eastern boundaries respectively of that section; thence by a right line to the left bank of the Grey River; thence generally in a south-easterly direction along the left bank of that river to a point in line with the north-western boundary of Section 3325; thence generally in a south-westerly direction, to and along the north-western boundary of that section, and by that boundary produced to the southern side of the Clarke Track; thence generally in an easterly direction by the southern side of that track to a point due south of the southernmost corner of Section 3325; thence by a right line bearing 183° 46′ for 39287·5 links to the point of commencement: excepting thereout Reserves 1150, 1153, 1154, 1155, 1157, 1158, 1164, and 1852 (gravel), Reserves 1350, 1351, 1352, and 1353 (public utility), Reserve 1052 (cemetery), Reserves 1355 and 1361 (school), Section 650, Block XII, Ahaura Survey District, extended alluvial claim (License 38/44), extended alluvial claim (License 79/43), Sections 7, 8, 9, 12, 18, and 24, Town of Orwell Creek, and all public roads. As the same is more particularly delineated on plan marked N. 6/8, deposited in the Head Office, Department of Mines at Wellington, and thereon bordered red.
