The Tauranga Milk District Constitution Order 1946

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 20th day of March, 1946
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred on him by the Milk Act, 1944, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby order and declare as follows :-
- This Order may be cited as the Tauranga Milk District Constitution Order 1946.
- The Borough of Tauranga is hereby constituted and declared a milk district under the Milk Act, 1944, as from the twenty-second day of March, one thousand nine hundred and forty-six, with the name of the "Tauranga Milk District."
- The Milk Authority of the said milk district shall be the the Tauranga Borough Council.

The North-western Side of Portion of Office Road, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the tenth day of September, one thousand nine hundred and forty-five, viz. :-
" The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, by resolution declares that the provision of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the north-west side of Office Road adjoining the land contained in the Certificate of Title, Volume 186, folio 155, part R.S. 105";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Office Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
THE north-western side of all that portion of street situated in the Canterbury Land District, City of Christchurch, known as Office Road, fronting part Rural Section 105. As the same is more particularly delineated on the plan marked P.W.D. 122994, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Vesting in the Poverty Bay Catchment Board Control of Watercourses in the Poverty Bay Catchment District

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 20th day of March, 1946
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
IN pursuance and exercise of the powers and authorities conferred by section one hundred and thirty of the Soil Conservation and Rivers Control Act, 1941, and of every other power and authority in anyway enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct as follows, viz. :-
That all watercourses within the Poverty Bay Catchment District, whether natural or constructed or hereafter to be constructed, together with all machinery and appliances used therewith, but excepting therefrom all water-supply races and stock-races which at the date of this Order in Council are under the control of any local authority, shall be under the exclusive care, control, and management of the Poverty Bay Catchment Board on and after the first day of April, one thousand nine hundred and forty-six.

Vesting in the Hawke's Bay Catchment Board Control of Watercourses in the Hawke's Bay Catchment District

IN pursuance and exercise of the powers and authorities conferred by section one hundred and thirty of the Soil Conservation and Rivers Control Act, 1941, and of every other power and authority in anyway enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct as follows, viz. :-
That all watercourses within the Hawke's Bay Catchment District, whether natural or constructed or hereafter to be constructed, together with all machinery and appliances used therewith, but excepting therefrom all water-supply races and stock-races which at the date of this Order in Council are under the control of any local authority, shall be under the exclusive care, control, and management of the Hawke's Bay Catchment Board on and after the first day of April, one thousand nine hundred and forty-six.

Vesting in the South Canterbury Catchment Board Control of Water-courses in the South Canterbury Catchment District and making Provisions as to the Cost of River Works

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 20th day of March, 1946
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
IN pursuance and exercise of the powers and authorities conferred by section one hundred and thirty of the Soil Conservation and Rivers Control Act, 1941, and of every other power and authority in anyway enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct as follows, viz. :-
(1) That all watercourses within the South Canterbury Catch-ment District, whether natural or constructed or hereafter to be constructed, together with all machinery and appliances used therewith, but excepting therefrom all water-supply races and stock-races which at the date of this Order in Council are under the control of any local authority, shall be under the exclusive care, control, and management of the South Canterbury Catchment Board on and after the first day of April, one thousand nine hundred and forty-six.
(2) That the whole cost of cleansing, repairing, maintaining, improving, or reconstructing those of the aforesaid watercourses that are situated in the Geraldine County River District, and the machinery and appliances used therewith, shall be provided and paid by the Geraldine County River Board.
(3) That the whole cost of cleansing, repairing, maintaining, improving or reconstructing those of the aforesaid water-courses that are situated in the County of Ashburton, and the machinery and appliances used therewith, shall be provided and paid by the Ashburton County Council.
(4) One month after the last day of March, June, September, and December in each year, the South Canterbury Catchment Board shall send to the Geraldine County River Board and to the Ashburton County Council a statement of the cost of cleansing, repairing, maintaining, improving, or reconstructing any watercourses situated within their respective districts, and the machinery and appliances used therewith, together with a demand for payment, such statement being compiled to the last day of the month of March, June, September, and December immediately preceding such statement.
(5) Within one month from the date of receipt of such statement of cost and demand, the Geraldine County River Board and the Ashburton County Council shall pay the respective amounts of the statements and demands in cash at the office of the South Canterbury Catchment Board at Timaru.
