The North-eastern Side of Portion of Shetland Street and the South-eastern Side of Portion of Greenhill Avenue, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 14th day of November, 1945
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the thirteenth day of August, one thousand nine hundred and forty-five, viz.:
“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz.:
“(a) The north-eastern side of the portion of Shetland Street adjoining part Lot 42, D.P. 1028, being part Section 20, Block III, Upper Kaikorai District;
“(b) The south-eastern side of the portion of Greenhill Avenue adjoining part Lot 42, D.P. 1028, being part Section 20, Block III, Upper Kaikorai District;
such land being comprised and described in Certificate of Title 147/226”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Shetland Street or fronting the south-eastern side of the portion of Greenhill Avenue (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE
THE north-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Shetland Street, fronting part Lot 42, D.P. 1028, Township of Anderson, being part Section 20, Block III, Upper Kaikorai District.
Also the south-eastern side of all that portion of street situated in the said land district and city, known as Greenhill Avenue, fronting part Lot 42, D.P. 1028, Township of Anderson, being part Section 20, Block III, Upper Kaikorai District.
As the same are more particularly delineated on the plan marked P.W.D. 122140, deposited in the office of the Minister of Works at Wellington, and thereon edged red.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the twenty-eighth day of August, one thousand nine hundred and forty-five, viz.:
“The Waitaki County Council, being the local authority having control of the roads in the County of Waitaki, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the west side of the road forming the eastern boundary of and abutting on part Section 38, Block V, Otepopo Survey District, comprised in Certificate of Title 241/61 Ltd.”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side generally of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE
THE western side generally of all that portion of road situated in the Otago Land District, County of Waitaki, fronting part Section 38, Block V, Otepopo Survey District. As the same is more particularly delineated on the plan marked P.W.D. 122266, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

“(b) The south-western side of the portion of Aytoun Street adjoining part Lot 53, Deeds Plan 114, Township of Shiel Hill, being part Section 2, Block VII, Anderson’s Bay District;
such land being comprised and described in Certificate of Title 275/185 Ltd.”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Albion Road or the south-western side of the portion of Aytoun Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the West Harbour Borough Council on the sixth day of November, one thousand nine hundred and forty-five, in so far as it affects the side and portions of street described in the Schedule hereto, viz.:
“The West Harbour Borough Council, being the local authority having control of the streets in the Borough of West Harbour, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Dunedin–Port Chalmers Main Highway adjoining that piece of land being Lot 3, D.P. 4297, and part Section 53, Block IX, North Harbour and Blueskin”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portions of the Dunedin–Port Chalmers Main Highway (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of street.
