Warrant vesting the Control of Mount Pleasant Street and Portions of High Street and Morningside Road in the Whangarei Borough Council and apportioning the Cost of Construction and Maintenance

IN pursuance and exercise of the power and authority vested in me by the Public Works Act, 1928, and of all other powers and authorities in anywise enabling me in this behalf, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby direct that Mount Pleasant Street and portions of High Street and Morningside Road lying along the boundary between the Borough of Whangarei and the Whangarei County, and described in the Schedule hereto, shall, on and after the date of the gazetting hereof, be under the control of the Whangarei Borough Council; and I do hereby further direct that the cost of constructing the said Mount Pleasant Street and portions of High Street and Morningside Road shall be borne by the Whangarei Borough Council and the Whangarei County Council in the following proportions, viz.: The Whangarei Borough Council shall bear seventy-five per centum of such cost and the Whangarei County Council shall bear twenty-five per centum of such cost respectively; and I do hereby further direct that the cost of maintaining the said street and portions of street and road shall be borne by the Whangarei Borough Council and the Whangarei County Council in equal proportions; and I do also further direct that any contribution hereby required to be made as aforesaid by the Whangarei County Council shall be paid from time to time in the proportions hereinbefore prescribed, out of the funds of the said Council, within a period of one month after demand in writing made by or on behalf of the Whangarei Borough Council, and all such payments shall be made from time to time to the Clerk, Whangarei Borough Council, for and on behalf of the said County Council.

SCHEDULE

ALL that street and portions of street and road in the North Auckland Land District, and lying along the boundary between the Borough of Whangarei and the Whangarei County, known as Mount Pleasant Street, High Street, and Morningside Road. As the same are more particularly delineated on the plan marked P.W.D. 121710, deposited in the office of the Minister of Works at Wellington, and thereon edged red.

As witness the hand of His Excellency the Governor-General, this 9th day of October, 1945.

Notifying the Proposed Exchange of Crown Land in the Canterbury Land District for other Land

WHEREAS by section one hundred and sixty of the Land Act, 1924, it is enacted that it shall be lawful for the Governor-General, whenever he deems it expedient in the public interest to grant in fee-simple any area of Crown land which is subject to the provisions of the Land Act, 1924, in exchange for the fee-simple of any other land, and on any such exchange to pay or receive any sum by way of equality of exchange:

And whereas in the opinion of the Governor-General it is expedient to exchange the Crown land described in the First Schedule hereto for the land described in the Second Schedule hereto, and the owner of the land described in the Second Schedule has agreed to such exchange, and has agreed to pay to the Crown a sum of money by way of equality of exchange:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule upon payment by the owner thereof of the sum of money hereinbefore referred to by way of equality of exchange.

FIRST SCHEDULE

DESCRIPTION OF LAND AUTHORIZED TO BE EXCHANGED

Canterbury Land District

ALL that area containing by admeasurement 34 acres 1 rood 36 perches, more or less, being part Lot 2 on plan deposited in the Land Registry Office at Christchurch as No. 7930, and being part Rural Sections 3117, 3119, 5203, 5230, and 10032, situated in Block IX, Leeston Survey District. As the same is more particularly delineated on the plan marked L. and S. 36/1505A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

SECOND SCHEDULE

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR

Canterbury Land District

ALL that area containing by admeasurement 35 acres 2 roods 36 perches, more or less, being Rural Section 24768, situated in Block XII, Selwyn Survey District. As the same is more particularly delineated on the plan marked L. and S. 36/1505B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered green.

As witness the hand of His Excellency the Governor-General, this 8th day of October, 1945.

Staff

Brigadier G. H. Clifton, D.S.O., M.C., is seconded for duty as Liaison Officer with United Kingdom and Australian organizations for recovery of Allied prisoners of war and interned civilians. Dated 14th September, 1945.

N.Z. STAFF CORPS

Captain (temp. Major) A. R. Currie, D.S.O., B.E., to be temp. Lieutenant-Colonel whilst holding the appointment of Assistant Director, Fortifications and Works. Dated 23rd July, 1945.

N.Z. ARMY ORDNANCE CORPS

Colonel (Acting-Brigadier) T. J. King, C.B.E., is seconded without pay and allowances to UNRRA for special duty. Dated 11th September, 1945.

N.Z. TEMPORARY STAFF

Temp. Major L. E. Earle ceases to be seconded to the War Assets Realization Board, and relinquishes his commission in the N.Z. Temporary Staff. Dated 24th September, 1945.
