Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby, in respect of each loan referred to in the Schedule hereto, vary the determinations in respect of the raising of such loan, in so far as such determinations apply to the raising of the said sum, by prescribing that no moneys shall be borrowed under the respective Order in Council after the twenty-seventh day of August, one thousand nine hundred and forty-seven.

Revoking the Reservation for Recreation Purposes over a Reserve in the City of Christchurch, Canterbury Land District

ORDER IN COUNCIL
At the Government House at Wellington, this 11th day of July, 1945

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS a notice of intention to issue an Order in Council declaring that the reservation for recreation purposes over the land described in the First Schedule hereto shall be revoked was published in the Gazette of the twenty-first day of September, one thousand nine hundred and forty-four:
And whereas such notice of intention was duly laid before both Houses of Parliament in accordance with the provisions of subsection two of section seven of the Public Reserves, Domains, and National Parks Act, 1928:
And whereas the Legislative Council and the House of Representatives, by resolutions dated respectively the eighth and the thirteenth days of December, one thousand nine hundred and forty-four, approved the proposed revocation as aforesaid:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for recreation purposes over the land described in the First Schedule hereto, and doth hereby declare that the said land, being vested in the body corporate called the Mayor, Councillors, and Citizens of the City of Christchurch, may be disposed of by the said body corporate by way of sale by public auction or private contract at such price and on such terms and conditions as the said body corporate shall determine, but so that the proceeds of any such sale shall be used and applied in or towards recouping the said body corporate for the moneys expended by it in the purchase for recreation purposes of the land described in the Second Schedule hereto.
FIRST SCHEDULE
CANTERBURY LAND DISTRICT
ALL that area containing by admeasurement 25·3 perches, more or less, being Lot 16, D.P. 10749, part Rural Section 54, situated in the City of Christchurch, and being the whole of the land comprised in Certificate of Title, Volume 449, folio 145 (Canterbury Registry). As the same is more particularly delineated on the plan marked L. and S. 1/975H, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
SECOND SCHEDULE
CANTERBURY LAND DISTRICT
ALL those areas containing together by admeasurement 1 acre 1 rood 1 perch, more or less, being Reserve 4452 (formerly Lots 7, 8, and 9, D.P. 5960, and Lots 10, 11, and 12, D.P. 6137), situated in the City of Christchurch. As the same are more particularly delineated on the plan marked L. and S. 1/975I, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Revoking the Reservation over a Reserve in Tatarariki Parish, North Auckland Land District

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for cemetery purposes over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.
SCHEDULE
NORTH AUCKLAND LAND DISTRICT
ALL that area in the Hobson County situated in Block X, Tokatoka Survey District, containing by admeasurement 1 acre, more or less, being Allotment 43, Parish of Tatarariki. As the same is more particularly delineated on the plan marked L. and S. 2/542A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon eged red.

The Eastern Side of Portion of Oxford Street, in the Borough of Marton, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 11th day of July, 1945

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Marton Borough Council on the second day of May, one thousand nine hundred and forty-five, viz.:
“ The Marton Borough Council, being the local authority having control of the streets in the Borough of Marton, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of the portion of Oxford Street adjoining that piece of land situate in the Borough of Marton, being part Section 18 on the plan of the Agricultural Reserve in the Rangitikei District, and being Lot 1 on Deposited Plan No. 8847, and being part of the land comprised in Certificate of Title, Volume 491, folio 95 (Wellington Registry) ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Oxford Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
THE eastern side of all that portion of street situated in the Wellington Land District, Borough of Marton, known as Oxford Street, adjoining Lot 1, D.P. 8347, being part Section 18, Rangitikei Agricultural Reserve. As the said portion of street is more particularly delineated on the plan marked P.W.D. 121744, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
