ORDER IN COUNCIL

At the Government Buildings at Wellington, this 26th day of March, 1945

Present:

THE HON. W. NASH PRESIDING IN COUNCIL

WHEREAS by section thirty of the Rabbit Nuisance Act, 1928, it is enacted that the Governor-General may, by Order in Council, on petition in that behalf signed by a majority of the persons qualified to be enrolled on the ratepayers’ list for any proposed district, constitute and declare any area of land not less than one thousand acres a rabbit district under and for the purposes of Part II of the said Act:

And whereas, in pursuance of the provisions of the said section thirty of the said Act, a petition has been received praying that the area of land described in the Schedule hereto be constituted and declared a rabbit district under and for the purposes of Part II of the said Act:

And whereas the said petition is signed by a majority of the persons in the said area of land qualified to be enrolled on the ratepayers’ list for the said proposed district, and it is deemed expedient to give effect to the prayer of the petitioners accordingly:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute by the specific name of the “Central Hawke’s Bay Rabbit District” and declare that area of land defined in the Schedule hereto to be a rabbit district under and for the purpose of Part II of the said Act; and doth hereby further declare that the basis on which the Board to be established for the said district shall first levy its general rate shall be on the basis of the acreage of the rateable property in the said district.


SCHEDULE

BOUNDARIES OF THE CENTRAL HAWKE’S BAY RABBIT DISTRICT

ALL that area in the Hawke’s Bay Land District, comprising the Waipukurau County and parts of the Waipawa and Patangata Counties, and bounded as follows.: Commencing at a point on the summit of the Ruahine Range due west of the headwaters of Gold Creek; thence due east by a right line to the headwaters of Gold Creek; thence in a general south-easterly direction along the right bank of Gold Creek, to and along the right bank of the Makaroro River to its confluence with the Waipawa River; thence south-easterly along the right bank of the Waipawa River to its confluence with the Tuki Tuki River; thence in a general north-easterly direction along the right bank of the Tuki Tuki River to the Mangarara Stream; thence south-easterly along the left bank of the Mangarara Stream, to and along the northern boundaries of Blocks 29, 28, 27, 26, 25, Mangakuri Crown Grant District, the northern and eastern boundaries of Block 24, the northern boundary of Block 36,

the northern and eastern boundaries of Block 37, the northern boundaries of Blocks 38, 39, the western and northern boundaries of Block 40, Mangakuri Crown Grant District, to the sea; thence southerly along the sea-coast to the north-eastern corner of Lot 11, D.P. 1215, at Arataura; thence north-westerly along the north-eastern boundaries of Lots 11, 9, and 5, D.P. 1215, Blocks 49, 26, 50, 21, 26, 30, 55, Tautane Crown Grant District, Lot 1, D.P. 117, and Block 58, Tautane Crown Grant District, to the north-eastern corner of Section 4, Block I, Tautane Survey District, on the Patangata County boundary; thence north-westerly along the south-western boundary of the Patangata County (as described in New Zealand Gazette, 1927, page 2929) to the northernmost corner of Section 1, Block XVI, Mangatoro Survey District, at its intersection with the eastern boundary of Section 5, Block XV, Mangatoro Survey District; thence northerly along that boundary of the said Section 5, Block XV, Mangatoro Survey District, to the south-eastern corner of Section 2, Block XII, Mangatoro Survey District; thence generally north-westerly along the eastern and northern boundaries of the Dannevirke County (as described in New Zealand Gazette, 1926, page 126) to the summit of the Ruahine Range; thence northerly along the summit of the Ruahine Range to the point of commencement.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Waitemata County Council stopping the portion of road described in the Schedule hereto.


SCHEDULE

APPROXIMATE area of the piece of road permitted to be stopped: 2 acres 2 roods 25 perches.

Adjoining or passing through Allotments S.W. 50, S.W. 61, M. 61, D.P. 3258, and N.E. 50, N.E. 51, Karangahape Parish.

Situated in Block V, Waitakerei Survey District (Auckland R.D.). (S.O. 32483.)

In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 120826, deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

IN pursuance and exercise of the powers and authorities conferred upon him by the Agricultural and Pastoral Societies Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby consent to the sale by the Marlborough Agricultural and Pastoral Association, a society duly incorporated under the said Act, of those pieces of land granted to and vested in the said association and more particularly described in the Schedule hereto.


SCHEDULE

FIRSTLY, all that piece of land containing 25 acres 3 roods, more or less, being Section 11, Block XVI, Cloudy Bay Survey District, and being all the land in Certificate of Title, Volume 13, folio 209 (Marlborough Land Registry).

Secondly, all that piece of land containing 16 acres 3 roods, more or less, being Sections 9 and 10A, Block XVI, Cloudy Bay Survey District, and being all the land in Certificate of Title, Volume 13, folio 207 (Marlborough Land Registry).
