Portions of Road, in the County of Waitaki, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 21st day of March, 1945 Present:
THE HON. W. NASH PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the twenty-seventh day of October, one thousand nine hundred and forty-four, in so far as it affects the portions of road described in the Schedule hereto, viz.:—
“ The Waitaki County Council, being the local authority having control of the roads in the Waitaki County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to both sides of the road abutting on parts of Allotment 13 on plans deposited in the Land Registry Office at Dunedin as Nos. 2017 and 2018, and being also parts Sections 1, 6, 10, 725R, and 880R, and parts of Application No. 2790, Block III, Sections 4, 5, 22, 23, and 881R, and parts Section 2, 6, 7, 15, 17, and 21, Block IV, on the public maps of the Kauroo Survey District, and being part of the land comprised and described in Certificate of Title, Register-book, Volume 236, folio 220 (Otago Land Registry) ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting portions of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of road.
SCHEDULE
ALL those portions of road in the Otago Land District, County of Waitaki, passing through parts Lot 13, Deposited Plans 2017 and 2018, Block IV, Kauroo District. As the same are more particularly delineated on the plan marked P.W.D. 120672, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
