Declaring Portion of Railway Land at Port Chalmers to be Crown Land

A PROCLAMATION

IN pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1928, and of every other power and authority in anywise enabling me in this behalf, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby declare the land described in the Schedule hereto to be Crown land subject to the Land Act, 1924.

SCHEDULE

APPROXIMATE area of the piece of land: 24·59 perches.
Part Railway land, formerly part of the Harbour of Port Chalmers.
Situated in the Borough of Port Chalmers. (S.O. 9405.)

In the Otago Land District; as the same is more particularly delineated on the plan marked I.O. 7697, deposited in the office of the Minister of Railways at Wellington, and thereon coloured yellow.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 17th day of February, 1945.

Boundaries of City of Christchurch and County of Heathcote altered

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 28th day of February, 1945

Present:

THE HON. W. NASH PRESIDING IN COUNCIL

WHEREAS in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Heathcote and included in the City of Christchurch:

And whereas it is deemed expedient to make such alteration of the boundaries of the said city:

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the said Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-five, the area described in the Schedule hereto shall be excluded from the County of Heathcote and included in the City of Christchurch.

SCHEDULE

AREA EXCLUDED FROM THE COUNTY OF HEATHCOTE AND INCLUDED IN THE CITY OF CHRISTCHURCH

ALL that area in the County of Heathcote, Canterbury Land District, bounded by a line commencing at a point on the boundary of the City of Christchurch (New Zealand Gazette, 1942, pages 2743–4), being a point on the eastern side of Mount Pleasant Road at the westernmost corner of Lot 1 on plan deposited in the Canterbury District Land Registry Office at Christchurch as No. 11515; thence proceeding generally southerly along the eastern side of Mount Pleasant Road aforesaid to a point in line with the south-eastern boundary of Lot 8 on plan deposited as aforesaid as No. 10400; thence south-westerly by a right line across Mount Pleasant Road, to and along the said south-eastern boundary of that lot and the south-eastern boundary of Lot 7 on plan deposited as aforesaid as No. 10400, and its production to the south-western side of Muritai Terrace; thence north-westerly along the south-western side of that terrace to and across Major Hornbrook Road; thence north-westerly and north-easterly along the south-western and north-western side of that road to the southernmost corner of Lot 1 on plan deposited as aforesaid as No. 9478; thence north-westerly along the south-western boundary of the said Lot 1 and Lot 7 on that plan and Lot 5 on plan deposited as aforesaid as No. 10015 to the southernmost corner of Lot 4 on plan No. 10015 aforesaid; thence north-easterly along the north-western boundary of the said Lot 4 and Lots 2 and 1 on the said plan to Major Hornbrook’s Road; thence north-easterly along the north-western side of that road to its intersection with the said boundary of the City of Christchurch at the south-eastern corner of R.S. 1161; thence generally north-easterly along that boundary to the point of commencement.

Domain Board appointed to have Control of the Fergusson Domain

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

His Worship the Mayor of Onehunga, ex officio,
Lewis Frederick Catt,
Thomas Roger Davies,
Joseph Barton Cox,
Frederick Gilchrist,
George Knights,
William Baden Powell Lee,
Wilfred Frank Cox, and
Dudley Garland Stone

to be the Fergusson Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Wednesday, the fourteenth day of March, one thousand nine hundred and forty-five, at eight o’clock p.m., as the time when, and the Merri-lands Hall, Onehunga, as the place where, the first meeting of the Board shall be held.

SCHEDULE

FERGUSSON DOMAIN.—NORTH AUCKLAND LAND DISTRICT

ALL that area in the Borough of Onehunga, containing by admeasurement 3 acres 0 roods 14·3 perches, more or less, being Lots 479 and 480 on Plan 17735, deposited in the office of the District Land Registrar, at Auckland, and being portions of Allotments 13 and 14 of Section 12, Suburbs of Auckland. As the same is more particularly delineated on the plan marked L. and S. 1/923, deposited in the Head Office, Department of Lands and Survey, at Wellington and thereon bordered red.
