Wholesalers' Prices
- (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any wholesaler for any oatmeal or rolled oats to which this Order applies shall be determined as follows:
(a) For oatmeal and rolled oats sold by any wholesaler whose place of business is situate in any of the cities or boroughs of Auckland, Blenheim, Christchurch, Dunedin, Gisborne, Greymouth, Hokitika, Invercargill, Napier, Nelson, New Plymouth, Oamaru, Tauranga, Timaru, Wanganui, Wellington, Westport, or Whangarei, the maximum wholesale price shall be:
(i) For oatmeal-

(2) The maximum prices fixed by the foregoing provisions of this clause shall be reduced by a discount of 2 ½ per cent. thereof where payment is made on or before the 20th day of the month following the month in which delivery is made to the retailer.
Retailers' Prices
- (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any retailer for any oatmeal or rolled oats to which this Order applies shall be determined as follows:
(a) For oatmeal and rolled oats sold by any retailer in any area within which any wholesaler carrying on business in any of the cities or boroughs of Auckland, Blenheim, Christchurch, Dunedin, Gisborne, Greymouth, Hokitika, Invercargill, Napier, Nelson, New Plymouth, Oamaru, Tauranga, Timaru, Wanganui, Wellington, Westport, or Whangarei normally undertakes the free delivery of goods to retailers, the maximum retail price shall be:

(2) Where any bulk oatmeal or rolled oats to which this Order applies is sold by retail in a lot other than one of the lots specified in subclause (1) of this clause, the maximum price of the lot shall be the price of the nearest lower specified lot increased as follows:
(a) In the case of retailers to whom paragraph (a) of subclause (1) of this clause applies: By 3 ¼d. a pound for oatmeal or 4 ½d. a pound for rolled oats (as the case may be) for each pound of the surplus:
(b) In the case of retailers to whom paragraph (b) of subclause (1) of this clause applies: By 4 ¼d. a pound for oatmeal or 4 ¾d. a pound for rolled oats (as the case may be) for each pound of the surplus.
(3) If in respect of any oatmeal or rolled oats sold by a retailer the maximum price calculated in accordance with the foregoing provisions of this clause is not an exact number of pence or half-pence, the maximum price of the lot may be increased to the nearest upward halfpenny.
(4) Notwithstanding anything in the foregoing provisions of this clause, and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any retailer, may authorize special maximum retail prices in respect of any oatmeal or rolled oats to which this Order applies where for any reason extraordinary freight charges are incurred by the retailer in obtaining delivery from the source of supply that is nearest or most convenient of access to him. Any authority given by the Tribunal under this subclause may apply with respect to a specified lot or consignment of oatmeal or rolled oats or may relate generally to all oatmeal or rolled oats sold by the retailer while the approval remains in force.

Price Order No. 317 (Apples and Pears)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:-
PRELIMINARY
- (1) This Order may be cited as Price Order No. 317.
(2) This Order shall come into force on the 19th day of February, 1945.
- (1) Price Orders No. 142† and No. 303‡ are hereby revoked.
(2) The revocation of the said Orders shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.
- (1) In this Order, unless the context otherwise requires,
"Bushel case", in relation to apples, means a package of the kind numbered 1 in the First Schedule to the New-Zealand-grown Fruit Regulations 1940§, and, in relation to pears, means a package of the kind numbered 2 in the said Schedule:
"Half-bushel case", in relation to apples, means a package of the kind numbered 5 or 6 in the First Schedule to the New-Zealand-grown Fruit Regulations 1940§, and, in relation to pears, means a package of the kind numbered 6 in the said Schedule:
"Internal Marketing Division" means the Internal Marketing Division of the Marketing Department:
"Retailer's railway-station", in relation to sales by a wholesaler to a retailer, means the railway-station that is nearest or most convenient of access to the retailer's premises.
(2) References in the First and Second Schedules to this Order to counts and grades are references to the counts and grades of apples and pears respectively, determined in accordance with the New-Zealand-grown Fruit Regulations 1940§, as modified in accordance with the Apple and Pear Marketing Regulations 1942||.
(3) Terms and expressions defined in the Control of Prices Emergency Regulations 1939,* when used in this Order, have the meanings severally assigned thereto by those regulations.
