The Northern Side of Portion of Parker Street, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government House at Wellington, this 25th day of October, 1944

Present:

His Excellency the Governor-General in Council

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the twelfth day of September, one thousand nine hundred and forty-four, viz.:

"The Motueka Borough Council, being the local authority having control of the streets in the Borough of Motueka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the northern side of the portion of Parker Street adjoining subdivision of part Reserve F (Section 186, part Section 159), District of Motueka, Blocks III and IV, Motueka Survey District (C.T. 62/29)";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Parker Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE
THE northern side of all that portion of street situated in the Nelson Land District, Borough of Motueka, known as Parker Street, fronting part Reserve F, also known as parts Sections 186 and 159, District of Motueka. As the same is more particularly delineated on the plan marked P.W.D. 120169, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The South-western Side of Portion of Perth Street, in the County of Oxford, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

His Excellency the Governor-General in Council

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Oxford County Council on the third day of August, one thousand nine hundred and forty-three, viz.:

"That the Oxford County Council, being the local authority having control of the streets (or roads) in the County of Oxford, declare that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of the portion of Perth Street adjoining the land contained in Certificate of Title 145/13, part of R.S. 1750, Block VIII, Oxford Survey District (Canterbury Lands Registry)";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE
THE south-western side of all that portion of road in the Canterbury Land District, County of Oxford, known as Perth Street, adjoining part Rural Section 1750, Block VIII, Oxford Survey District. As the same is more particularly delineated on the plan marked P.W.D. 118032, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

"The Richmond Borough Council, being the local authority having control of the roads in the Borough of Richmond, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of Wensley Road, fronting part Section 24, Waimea East, Block VII, Waimea Survey District, and contained in the Certificate of Title, Volume 56, folio 82";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Wensley Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE
THE north-western side of all that portion of street situated in the Nelson Land District, Borough of Richmond, known as Wensley Road, fronting part Section 24, Waimea East District, Block VII, Waimea Survey District. As the same is more particularly delineated on the plan marked P.W.D. 120181, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
