Boundaries of City of Christchurch and County of Heathcote altered

At the Government House at Wellington, this 18th day of October, 1944
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Heathcote and included in the City of Christchurch:
And whereas it is deemed expedient to make such alteration of the boundaries of the said city:
Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the said Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-five, the area described in the Schedule hereto shall be excluded from the County of Heathcote and included in the City of Christchurch.
SCHEDULE
AREA EXCLUDED FROM THE COUNTY OF HEATHCOTE AND INCLUDED IN THE CITY OF CHRISTCHURCH
ALL that area in the County of Heathcote, Canterbury Land District, bounded by a line commencing at a point on the intersection of the north-eastern boundary of the Christchurch-Lyttelton Railway land with the northern boundary of Rural Section 91, the said point being on the boundary of the City of Christchurch, Block XVI, Christchurch Survey District (New Zealand Gazette, 1942, pages 2743-4); thence proceeding in a westerly direction along the northern boundary of Rural Section 91 aforesaid; thence southerly along its western boundary to the easternmost corner of Lot 1 on plan deposited in the office of the Canterbury District Land Registrar at Christchurch as No. 6729; thence south-westerly along the south-eastern boundary of that lot to and across Opawa Road; thence north-westerly along the south-western side of that road to the south-eastern boundary of Reserve 3803; thence south-westerly and westerly along the south-eastern and southern boundaries of Reserve 3803 aforesaid, to and across Bishopworth Street, and along the southern boundary of the land contained in Certificate of Title, Volume 294, folio 59, Canterbury Registry, to and across Port Hills Road; thence north-westerly along the south-western side of that road to the eastern boundary of Lot 3 on plan deposited as aforesaid as No. 10809; thence southerly along the said eastern boundary of that lot and the eastern boundary of Lot 1 on plan deposited as aforesaid as No. 5798 to the south-eastern corner of that lot; thence westerly along the southern boundaries of the said Lot 1 and Lots 2 and 4 on plan deposited as aforesaid as No. 8156 to and across Rapaki Road; thence southerly along the western side of that road to the northern boundary of Lot 2 on plan deposited as aforesaid as No. 9206; thence westerly along the said northern boundary of that lot to and across Vernon Terrace; thence northerly along the western side of that terrace to the southern boundary of Lot 133 on plan deposited as aforesaid as No. 675; thence westerly along the southern boundary of that lot across a drain to the south-eastern corner of Lot 100 on plan deposited as aforesaid as No. 675; thence northerly and westerly along the eastern and northern boundaries of that lot to and across Victoria Road; thence westerly along the northern side of Roscoe Street and its production across Albert Terrace to a point on the boundary of the City of Christchurch aforesaid; thence generally northerly, south-easterly, north-easterly, and south-easterly by that boundary to the point of commencement.

The Western Side of Portion of Gudgeon Street, in the City of Auckland, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 18th day of October, 1944

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the seventh day of September, one thousand nine hundred and forty-four, in so far as it affects the side and portion of street described in the Schedule hereto, viz.:
“The Auckland City Council, being the local authority having control of the streets in the City of Auckland, hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Gudgeon Street adjoining part Allotment 16, Section 8, Suburbs of Auckland”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Gudgeon Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
THE western side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Gudgeon Street, fronting Lot 12, D.P. 110, being part Allotment 16, Section 8, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 120191, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Northern Side generally of Portion of a Road, in the County of Otorohanga, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 18th day of October, 1944
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Otorohanga County Council on the twenty-sixth day of September, one thousand nine hundred and forty-four, in so far as it affects the portion of road described in the Schedule hereto, viz.:
“The Otorohanga County Council, being the local authority having control of the Crown Grant road bounding the Mangaorongo Stream and adjoining those parts of Section 3, Block II, Mangaorongo Survey District, edged green on a Public Works Department plan number 119656, being parts of the land in Certificate of Title, Register-book, Volume 243, folio 72 (Auckland Registry), doth hereby declare that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the said road”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side generally of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE
THE northern side generally of all that portion of road situated in the Auckland Land District, County of Otorohanga, adjoining part of Section 3, Block II, Mangaorongo Survey District. As the said portion of road is more particularly delineated on the plan marked P.W.D. 119656, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Calmady Terrace, in the Borough of New Plymouth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 18th day of October, 1944

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the third day of June, one thousand nine hundred and forty, the side and portion of street affected by the resolution being more particularly described in the Schedule hereto, viz.:
“That the New Plymouth Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply to that portion of the northern side of Calmady Terrace to which Sections 2087, 2088, 2089, and 2090, New Plymouth, have frontages”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Calmady Terrace (described in the Schedule hereto) within a distance of ten feet from the northern boundary of the said portion of street.
