The South-eastern Side of Portion of Sutherland Street, in the County
of Waimairi, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the Building-
line

ORDER IN COUNCIL.
At the Government House at Wellington, this 4th day of
October, 1944.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the Waimairi County
Council on the sixteenth day of February, one thousand nine
hundred and forty-four, the portion of street affected by such
resolution being more particularly described in the Schedule hereto:-
"That the Waimairi County Council, being the local
authority having control of the roads in the County of Wai-
mairi, by resolution declares that the provision of section one
hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to the side of Sutherland Street adjoining Lot
73, D.P. 121, part B.S. 132, and contained in Certificate of
Title, Volume 207, folio 75 (Canterbury Survey District)";
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-eastern side
of the portion of Sutherland Street (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-line of the said
portion of road.
SCHEDULE
The south-eastern side of all that portion of road situated in the
Canterbury Land District, County of Waimairi, known as Sutherland
Street, fronting Lot 73 on Deposited Plan No. 121, being part of
Rural Section 182, Block XIV, Christchurch Survey District. As
the said portion of road is more particularly delineated on the plan
marked P.W.D. 119658, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.

exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

on the tenth day of August, one thousand nine hundred and forty-
four; viz. :-
"The Blenheim Borough Council, being the local authority
having control of the roads in the Borough of Blenheim, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the southern side of Monro and western side of Poynter
Streets fronting Allotments 560 and 561 of Section 1/3, Omaka,
Borough of Blenheim, and contained in the Certificate of Title,
Volume 17, folio 131";
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern side of
portion of Monro Street or the western side of portion of Poynter
Street (described in the Schedule hereto) within a distance of thirty-
three feet from the centre-lines of the said portions of streets.
SCHEDULE
The southern side of all that portion of the street known as Monro
Street, situated in the Marlborough Land District, Borough of
Blenheim, adjoining Lot 561, D.P. 523, part Section 3, Omaka
District.
Also the western side of all that portion of the street known as
Poynter Street, situated in the said land district and borough,
adjoining Lots 560 and 561, D.P. 523, part Section 3, Omaka District.
As the same are more particularly delineated on the plan marked
P.W.D. 120049, deposited in the office of the Minister of Works at
Wellington, and thereon coloured red.

shall not apply to the southern side of Mowat Street fronting
subdivision of Lot 13 and part Lots 14, 19, 20, 21, and 22,
D.P. 13A, Part 5, Omaka, Block XVI, Cloudy Bay Survey
District, and contained in the Certificate of Title, Volume 10,
folio 258" ;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the portion of Mowat
Street (described in the Schedule hereto) within a distance of thirty-
five feet from the centre-line of the said portion of road.
SCHEDULE
The southern side of all that portion of road in the Marlborough
Land District, County of Marlborough, known as Mowat Street,
fronting Lot 13 and part Lots 14, 19, 20, 21, and 22, D.P. 13A,
part Section 5, Omaka District. As the same is more particularly
delineated on the plan marked P.W.D. 120051, deposited in the
office of the Minister of Works at Wellington, and thereon coloured
red.

heim, exempted from the Provisions of Section 128 of the Public
Works Act, 1928, subject to a Condition as to the Building-line

of street.
SCHEDULE
The western side of all that portion of street situated in the Marl-
borough Land District, Borough of Blenheim, known as Cubitt
Street, fronting part Lot 11, Deeds Plan 21, part Section 2, Omaka
District. As the same is more particularly delineated on the plan
marked P.W.D. 120050, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.
