Price Order No. 265 (Second-hand Sacks)
Pursuant to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order.
PRELIMINARY
- This Order may be cited as Price Order No. 265, and shall come into force on the 7th day of August, 1944.
- (1) Price Order No. 150t is hereby revoked.
(2) The revocation of the said Price Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order. - (1) In this Order--
"The said specification" means the New Zealand Emergency Standard Specification (No. N.Z.S.S. E. 154) entitled "Second-hand Sacks and Bags", issued by the New Zealand Standards Institute under the authority of the Minister of Industries and Commerce, and, subject to the proviso hereto, includes any amendment of the said specification that may hereafter be made : Provided that for the purposes of this Order, no such amendment shall have any effect before the expiration of seven days after the date of publication in the Gazette of a notification of the making of the amendment.
(2) References in this Order to the class, description, grade, or type of any second-hand sacks or bags shall be deemed respectively to be references to the class, description, grade, or type of such sacks or bags within the meaning and for the purposes of the said specification.
APPLICATION OF THIS ORDER
- This Order applies with respect to all sales of empty second-hand sacks or bags of any of the classes, descriptions, grades, or types specified in the Schedule hereto.
Fixing Maximum Selling-Price of Second-Hand Sacks and Bags to which this Order Applies
- (1) Subject to the following provisions of this clause the maximum price that may be charged or received by any person for any second-hand sacks or bags to which this Order applies shall be the appropriate price fixed in the Schedule hereto.
(2) The maximum prices fixed in the Schedule hereto are fixed as for delivery by the seller free-on-board or free-on-rail at the port or railway-station (as the case may be) that is the nearest or most convenient of access to the seller's premises.
(3) Where any sacks or bags to which this Order applies are delivered by the seller otherwise than free-on-board or free-on-rail as aforesaid, the maximum price that may be charged by the seller shall be the maximum price as fixed in the Schedule hereto, increased by any transport charges incurred by the seller in effecting delivery and then reduced by the amount of the transport charges that he would have incurred if he had delivered the sacks or bags free-on-board or free-on-rail as aforesaid.
