Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint
Henry Albert Belk,
William Prime,
Richard William Sullivan,
Daniel Wallace Thurston, and
Gladwynne Maurice Transom

to be the Torere Domain Board, having control of the land described in the Schedule hereto, and doth hereby appoint Wednesday, the first day of March, one thousand nine hundred and forty-four, at eight o'clock p.m., as the time when, and the residence of Mr. Belk, as the place where, the first meeting of the Board shall be held.

Vesting a Reserve in the Mount Herbert County Council

At the Government Buildings at Wellington, this 26th day of January, 1944

Present:
THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

WHEREAS the land described in the Schedule hereto has been duly set apart for plantation purposes: And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Chairman, Councillors, and Inhabitants of the County of Mount Herbert:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Chairman, Councillors, and Inhabitants of the County of Mount Herbert, in trust, for plantation purposes.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for street.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimairi County Council on the twentieth day of October, one thousand nine hundred and forty-three, viz.:—

“The Waimairi County Council, being the local authority having control of the roads in the County of Waimairi, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of the portion of Walters Road, fronting part of Lot 23, Deposit Plan 772, Rural Section 386, Block VII, Christchurch Survey District, and described in Certificate of Title 319/30 (Canterbury Land Registry) ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of portion of Walters Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

THE western side of all that portion of road situated in the Canterbury Land District, County of Waimairi, known as Walters Road, fronting part Lot 23, D.P. 772, part Rural Section 6386, Block VII, Christchurch Survey District. As the same is more particularly delineated on the plan marked P.W.D. 118285, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The South-western Side of Portion of and the North-western Side of Portion of Nicholas Street, in the City of Auckland, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to Conditions as to the Building-line

At the Government Buildings at Wellington, this 26th day of January, 1944

Present:
THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the twenty-second day of July, one thousand nine hundred and forty-three (the sides and portions of street affected by such resolution being more particularly described in the Schedule hereto), viz.:—

“The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Nicholas Street adjoining Lot 7 of subdivision of Allotments 1, 2, 7–10, 23–27, and adjoining portion of Allotment 24, both of Section 40, City of Auckland, Certificates of Title 26/253, 81/42, and 599/263 ”;

subject to the condition that no shop or other building with a public entrance to Nicholas Street and no shop window fronting the said street displaying wares for sale shall at any time be erected or permitted to be used on the land fronting the south-western side of portion of Nicholas Street or the north-western side of portion of Nicholas Street (described in the Schedule hereto) within a distance of twenty feet from the centre-lines of the said portions of street, and that no building for residential purposes shall at any time be erected or permitted to be used on the said land within a distance of thirty-three feet from the centre-lines of the said portions of street.

THE south-western side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Nicholas Street, fronting Lot 7 of subdivisions of Allotments 1, 2, 7, 8, 9, 10, 23, 24, 25, 27, and 26 of Section 40, City of Auckland, and portion of Lot 24 of Section 40, City of Auckland.

Also the north-western side of all that portion of the said Nicholas Street fronting Lot 7 of subdivisions of Allotments 1, 2, 7, 8, 9, 10, 23, 24, 25, 27, and 26 of Section 40, City of Auckland.

As the same are more particularly delineated on the plan marked P.W.D. 117734, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
