Price Order No. 243 (Australian Oranges and Lemons)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order :—
- (1) This Order may be cited as Price Order No. 243, and shall come into force on the 3rd day of June, 1944.
(2) Price Order No. 178† is hereby revoked.
(3) The revocation of the said Price Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.
- (1) In this Order, unless the context otherwise requires,—
“ The said regulations ” means the Control of Prices Emergency Regulations 1939* :
“ Bushel case ” means an Australian case of the type and specification used in the ordinary course of trade for packing the quantity of oranges or lemons recognized as one bushel.
(2) References in this Order to metropolitan areas are references to the metropolitan areas described in the Schedule hereto.
(3) Terms and expressions defined in the said regulations, when used in this Order, have the meanings severally assigned thereto by those regulations.
- The maximum prices fixed by this Order include the prices of the cases or other containers in which the oranges or lemons are delivered to the purchaser.
APPLICATION OF THIS ORDER

This Order applies with respect to oranges and lemons grown in Australia and sold in New Zealand.

The maximum prices fixed by this Order apply with respect to sales by auction, as well as to other sales.

(1) The provisions of this Order as to maximum wholesale prices shall apply notwithstanding that any oranges or lemons to which this Order applies are sold otherwise than in bushel cases, and the provisions of this Order as to maximum retail prices shall apply notwithstanding that any such oranges or lemons are sold otherwise than by weight.
(2) If any lot of oranges or lemons to which this Order applies is sold by a wholesaler otherwise than in bushel cases, the maximum price of the lot shall bear the same proportion to the maximum price of a bushel-case lot as the net weight of the lot bears to the customary net weight of a bushel case.
MAXIMUM WHOLESALE PRICES
- (1) Subject to the provisions of this clause, the maximum price that may be charged or received by any wholesaler for any oranges or lemons to which this Order applies shall be—
(a) When sold to a retailer carrying on business in any of the metropolitan areas of Auckland, Wellington, Christchurch, or Dunedin, or in any of the cities or boroughs of Whangarei, Hamilton, Gisborne, New Plymouth, Stratford, Wanganui, Palmerston North, Napier, Hastings, Blenheim, Nelson, Greymouth, Timaru, Oamaru, Gore, or Invercargill—
Oranges, per bushel case .. .. 32 6

(b) When sold to a retailer carrying on business elsewhere—

(2) The wholesale prices fixed by this Order are fixed as for delivery at the wholesaler’s store or other premises occupied by the wholesaler.
(3) Where delivery is effected by a wholesaler elsewhere than at premises occupied by him, he may add to the appropriate price fixed by this Order the reasonable cost of delivery, not exceeding in any case the cost that would have been incurred by him if delivery had been effected by a common carrier at current freight rates.
MAXIMUM RETAIL PRICES
- (1) Subject to the provisions of this clause the maximum retail price that may be charged or received by any retailer for any oranges or lemons to which this Order applies shall be computed as follows :—
Oranges : At the rate of 11d. per pound.
Lemons : At the rate of 1s. 1½d. per pound.
(2) If in respect of any lot of such oranges or lemons sold by a retailer the maximum price calculated in accordance with the foregoing provisions of this clause is not an exact number of pence or half-pence, the maximum price of the lot shall be computed to the nearest upward halfpenny.
- Every retailer who offers or exposes for sale in any shop any oranges or lemons to which this Order applies shall keep in a prominent position in such proximity to the oranges or lemons to which it relates as to be obviously descriptive thereof a ticket, placard, or label on which shall be stated in legible and prominent characters the following particulars :—
(a) The retail price per pound of the oranges or lemons (as the case may be) :
(b) The word “ Australian.”
