NOTICE is hereby given in pursuance of the Regulations Act, 1936, of the making of regulations and orders as under :

Price Order No. 238 (New Zealand Lemons other than Meyer Lemons)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order :

1. This Order may be cited as Price Order No. 238, and shall come into force on the 1st day of June, 1944.
2. (1) Price Order No. 179† is hereby revoked.
   (2) The revocation of the said Price Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.
3. (1) In this Order, unless the context otherwise requires,—
   “ The said regulations ” means the Control of Prices Emergency Regulations 1939* ;
   “ Three-quarter-bushel case ” means either a package of the kind numbered 3 in the First Schedule to the New-Zealand-grown Fruit Regulations 1940‡ (as substituted by Regulation 6 of the New-Zealand-grown Fruit Regulations 1940, Amendment No. 3§), or a package having the following dimensions (inside measurements)— namely, depth, 7⅞ in.; width, 11½ in.; length, 18 in.
   (2) References in this Order to metropolitan areas are references to the metropolitan areas described in the Schedule hereto.
   (3) Terms and expressions defined in the said regulations, when used in this Order, have the meanings severally assigned thereto by those regulations.
4. The maximum prices fixed by this Order include the prices of the cases or other containers in which the lemons are delivered to the purchaser.
   APPLICATION OF THIS ORDER
5. This Order applies with respect to all New-Zealand-grown lemons other than Meyer lemons.
6. The maximum prices fixed by this Order apply with respect to sales by auction, as well as to other sales.
7. (1) The provisions of this Order as to maximum wholesale prices shall apply notwithstanding that any lemons to which this Order applies are sold otherwise than in three-quarter-bushel cases, and the provisions of this Order as to maximum retail prices shall apply notwithstanding that any such lemons are sold otherwise than by weight.
   (2) If any lot of lemons to which this Order applies is sold by a wholesaler otherwise than in three-quarter-bushel cases, the maximum price of the lot shall bear the same proportion to the maximum price of a three-quarter-bushel-case lot as the net weight of the lot bears to the customary net weight of a three-quarter-bushel case.
