A PROCLAMATION

IN pursuance and exercise of the powers conferred by section twelve of the Land Act, 1924, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby proclaim as road the land described in the Schedule hereto.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 3rd day of May, 1944.

Revoking Part of a Proclamation altering a Proclamation defining the Middle-line of a Portion of the Wellington – New Plymouth Railway (Wellington – Tawa Flat Deviation)

A PROCLAMATION

IN pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1928, and of every other power and authority in anywise enabling me in this behalf, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby revoke the Proclamation dated the twenty-sixth day of May, one thousand nine hundred and twenty-seven, and published in the New Zealand Gazette No. 38 of the second day of June, one thousand nine hundred and twenty-seven, altering a Proclamation defining the middle-line of a portion of the Wellington – New Plymouth Railway (Wellington – Tawa Flat Deviation), in so far as it affects part Subdivision B of Sections 8 and 9, Ngahauranga Native Reserve, being the land comprised and described in Certificate of Title, Volume 493, folio 7 (Wellington Registry).

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 3rd day of May, 1944.

Amending the Foreshore Licenses vesting the Management of certain Wharves in the Akaroa County Council

At the Government House at Wellington, this 3rd day of May, 1944

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby amend the respective Orders in Council set out in the Schedule hereto, vesting the management of certain wharves in the Akaroa County Council, by revoking clause one in the First Schedule to the Orders in Council set out in the Schedule hereto, and substituting the following clause :—

“ 1. The vesting of the management of the wharves referred to in the respective Orders in Council set out in the Schedule hereto is subject to the Foreshore License Regulations 1940, with the exception of clauses twenty and twenty-one of the said regulations which for the purpose of this Order in Council are hereby excluded, and the provisions of the said regulations shall, so far as applicable, apply hereto.”

Vesting the Management of the Wharf at Pigeon Bay in the Akaroa County Council

ORDER IN COUNCIL

At the Government House at Wellington, this 3rd day of May, 1944

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vest in the Akaroa County Council (hereinafter called “the Council,” which term shall include its successors or assigns unless the context requires a different construction) the management of the wharf at Pigeon Bay, as shown on approved plans marked M.D. 927 and 928, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon the wharf as shown on the said plans, such vesting to be subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

  1. THE vesting of the management of the said wharf is subject to the Foreshore License Regulations 1940, with the exception of clauses 20 and 21 of the said regulations which for the purpose of this Order in Council are hereby excluded, and the provisions of the said regulations shall, so far as applicable, apply hereto.

  2. The term of the vesting shall extend to the 20th day of December, 1955.

  3. The master of every vessel discharging ballast at the said wharf shall have all such ballast taken away and deposited above high-water mark, or at such place as may be approved of by the Minister or by any person appointed by the Minister for that purpose.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the sixteenth day of February, one thousand nine hundred and forty-four, the Honourable Erina Harvey Northcroft was appointed a member of the First Division of the Court of Appeal and the Honourable George Panton Finlay was appointed a member of the Second Division of the said Court for the year one thousand nine hundred and forty-four:

And whereas it is expedient that for the purposes of the sittings of the said Court to be held in the months of June and September, one thousand nine hundred and forty-four, the personnel of the two Divisions should be altered by the revocations and appointments hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of that Dominion, and in exercise of the authority conferred upon him by the Judicature Amendment Act, 1913, and in pursuance of the recommendation of the Right Honourable the Chief Justice, the Honourable Mr. Justice Smith, the Honourable Mr. Justice Johnston, and the Honourable Mr. Justice Finlay, doth revoke the appointment of the Honourable Erina Harvey Northcroft as a member of the First Division of the Court of Appeal and of the appointment of the Honourable George Panton Finlay as a member of the Second Division of the said Court, and doth appoint the said the Honourable Erina Harvey Northcroft to be a member of the Second Division of the Court in place of the said the Honourable George Panton Finlay, and doth appoint the said the Honourable George Panton Finlay to be a member of the said First Division in place of the said the Honourable Erina Harvey Northcroft.
