NOTICE is hereby given in pursuance of the Regulations Act, 1936, of the making of regulations and orders as under:

The South Island Potatoes Control Order 1944
PURSUANT to the Primary Industries Emergency Regulations 1939*, the Minister of Agriculture doth hereby order and direct as follows:-

  1. This Order may be cited as the South Island Potatoes Control Order 1944, and shall come into force on the 1st day of May, 1944.
  2. While this Order continues in force no person shall ship any potatoes from any port in the South Island to any port in the North Island, and no person in the South Island shall accept delivery of any potatoes for shipment to the North Island unless the following conditions have been complied with, namely:-
    (a) Potatoes intended for use as seed potatoes shall be packed in bags or other containers, conspicuously branded or marked with the word "Seed" in large capital letters;
    (b) In the case of other potatoes, there shall be produced to the person accepting delivery of the potatoes for shipment, either-
    (i) A certificate signed by a recognized or approved grader to the effect that the potatoes are of fair average quality, in accordance with the rules prescribed in that behalf by the Price Tribunal in Price Order No. 196† or in accordance with any Price Order that may hereafter be substituted therefor; or
    (ii) Written or other satisfactory evidence that the potatoes are being shipped with the consent of the Primary Industries Controller or of a person acting with the authority of the Controller.
  3. Every person shall be deemed to have committed a breach of this Order who-
    (a) Ships any potatoes, or causes or permits any potatoes to be shipped, contrary to the provisions of this Order; or
    (b) Accepts any potatoes for shipment contrary to the provisions of this Order ; or
    (c) Accepts delivery in the North Island of any potatoes which, at the time of delivery, he knew, or ought to have known, had been shipped from the South Island contrary to the provisions of this Order ; or
    (d) Sells, or otherwise disposes of, or uses, except as seed potatoes, any potatoes that have been consigned as seed potatoes under this Order.

    Revocation of Notice relating to Conditions of Sale of South Island Potatoes
    THE notice relating to conditions of sale of South Island potatoes, dated the 29th day of August, 1940 and published in the Gazette* of the 30th day of the same month, is hereby revoked.
    Dated at Wellington, this 27th day of April, 1944.
