Authorizing the Judges of the Second Division of the Court of Appeal
to sit with the Judges of the First Division

ORDER IN COUNCIL
At the Government House at Wellington, this 15th day of March,
1944
Present:
His Excellency the Governor-General in Council
WHEREAS by section nine of the Judicature Amendment Act,
1913, it is enacted that each Division of the Court of Appeal
shall sit and exercise its jurisdiction separately, save that in respect
of any sitting of either Division the Governor-General in Council
may, on the certificate of two Judges (of whom the Chief Justice
shall be one) that any appeal or other proceeding is of special
difficulty or importance, authorize all the Judges of the other
Division to sit together with those of the former Division for the
hearing and determination of that appeal or proceeding:
And whereas an application was made by a prisoner, Leonard
Neilng, under section two of the Crimes Amendment Act, 1920,
for leave to appeal against sentence, which application was con-
sidered by the Second Division of the Court of Appeal at its sitting
held in September, one thousand nine hundred and forty-three,
but was not determined :
And whereas such application is now listed and stands for
hearing before the First Division of the Court of Appeal at the
sitting which commenced on the sixth day of March, one thousand
nine hundred and forty-four:
And whereas the Right Honourable Sir Michael Myers, G.C.M.G.,
Chief Justice of New Zealand, and the Honourable Robert Kennedy,
a Judge of the Supreme Court of New Zealand, have certified that
the said application presents a question of special difficulty and
importance:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, in pursuance of the authority vested in
him in that behalf as aforesaid, and acting by and with the advice
of the Executive Council of the said Dominion, doth hereby authorize
the Judges of the Second Division of the Court of Appeal to sit
with the Judges of the First Division of that Court at the aforesaid
sitting for the hearing and determination of the said application.

The Oil Fuel (Horse Transport) Control Notice 1944 (No. 2)
PURSUANT to the Supply Control Emergency Regulations 1939
and the Oil Fuel Emergency Regulations 1939, I, Daniel
Giles Sullivan, the Minister of Supply and Munitions, hereby give
notice and direct as follows:—
- This notice may be cited as the Oil Fuel (Horse Transport)
Control Notice 1944 (No. 2). - (1) The Oil Fuel (Horse Transport) Control Notice 1944*
is hereby revoked.
(2) The revocation of the said notice shall not affect the
liability of any person for any offence in relation thereto committed
before the coming into force of this notice. - In this notice the expression “oil fuel” includes oil fuel as
defined in the Oil Fuel Emergency Regulations 1939, and also
includes char, as so defined. - Except as provided in clause 5 hereof, no person shall use
oil fuel in any motor-vehicle which is being used for the transport
of any horse or horses upon any road or street, whether the horse
or horses are in the vehicle or in any trailer being towed by the
vehicle. - Nothing in clause 4 hereof shall apply to prohibit the use
of any one or more motor-vehicles for the transportation of a horse
for farming purposes only or in any case where the horse is trans-
ported for any distance or distances not exceeding thirty miles in all.
Provided that nothing herein shall be deemed to permit the use
of a motor-vehicle for any such purpose if that use is prohibited
under any other enactment.
