Portions of Graham’s Cross Road and Portion of Unnamed Road, in
the County of Marlborough, exempted from the Provisions of
Section 128 of the Public Works Act, 1928, subject to a Condition
as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 7th day of April,
1943.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the Marlborough
County Council on the nineteenth day of March, one thousand nine
hundred and forty-three, the portions of road affected by such
resolution being described in the Schedule hereto, viz.:
“ The Marlborough County Council, being the local authority
having control of the roads in the County of Marlborough, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the portion of Graham’s Cross Road between the New
Renwick Road and the southern bank of the Fairhall River and
the eastern side of the portion of Graham’s Cross Road between
the southern bank of the Fairhall River and the Middle Renwick
Road, and the road through part Section 21, Omaka Regis-
tration District, between the Middle Renwick Road and the
Fairhall River, all adjoining part Sections 21, 23, 24, 72, 77, and
192, Omaka Registration District, and old river-bed, Block XIV,
Cloudy Bay Survey District, comprised in Certificates of Title
35/283, 35/291, 1/192 ”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the eastern side of the
portion of Graham’s Cross Road firstly described in the Schedule
hereto, the sides of the portion of Graham’s Cross Road secondly
described in the Schedule hereto, or the sides of the portion of
unnamed road thirdly described in the Schedule hereto within a
distance of thirty-three feet from the centre-lines of the said portions
of roads.

SCHEDULE.
THE eastern side of all that portion of road situated in the
Marlborough Land District, County of Marlborough, known as
Graham’s Cross Road, between the southern bank of the Fairhall
River and the Middle Renwick Road.
Also all that portion of the said Graham’s Cross Road in the said
land district and county between the New Renwick Road and the
southern bank of the Fairhall River.
Also all that portion of unnamed road in the said land district
and county passing through part Section 21, District of Omaka,
between the Middle Renwick Road and the Fairhall River.
As the same are more particularly delineated on the plan marked
P.W.D. 116657, deposited in the office of the Minister of Public
Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Customhouse Quay, in the City
of Wellington, exempted from the Provisions of Section 128 of the
Public Works Act, 1928.

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the Wellington City Council on
the eleventh day of November, one thousand nine hundred and
forty-two, viz.:
“ The Wellington City Council, being the local authority
having control of the streets in the City of Wellington, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not apply
to that part of the eastern side of Customhouse Quay fronting
Sections 22 and 23, Provincial Government Reclamation, being
land comprised in C.T. 435/146 ”;
the portion of street affected by such resolution being described in the
Schedule hereto.

SCHEDULE.
THE south-eastern side of all that portion of street situated in the
Wellington Land District, City of Wellington, known as Customhouse
Quay, fronting Sections 22 and 23, Provincial Government Reclama-
tion. As the same is more particularly delineated on the
plan marked P.W.D. 116434, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

ORDER IN COUNCIL.
At the Government House at Wellington, this 31st day of March,
1943.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance of the Harbours Act, 1923, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby license and permit Cyril
Boxwell Williams, of Rawene (hereinafter called “ the licensee,”
which term shall include his executors, administrators, or assigns,
unless the context requires a different construction), to use and
occupy, as a site for a shop, that part of the foreshore at Rawene,
Hokianga Harbour, as shown on plan marked M.D. 4402 and
deposited in the office of the Marine Department at Wellington,
such license to be held and enjoyed by the licensee upon and subject
to the terms and conditions set forth in the Schedule hereto.

SCHEDULE.

  1. THIS license is subject to the Foreshore License Regulations 1940,
    and the provisions of those regulations shall, so far as applicable,
    apply hereto.
  2. The term of the license shall be fourteen years from the 25th
    day of March, 1943.
  3. The premium payable by the licensee shall be one pound (£1)
    and the annual sum so payable five pounds (£5).

At the Government House at Wellington, this 31st day of March,
1943.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by section four of the Public Service Act, 1912,
it is enacted that nothing in that Act shall apply to any
officer or class of officers to whom or to which, on the recom-
mendation of and for special reasons assigned by the Commissioner,
the Governor-General in Council declares that the said Act shall
not apply :
And whereas the Commissioner has recommended that the
Public Service Act, 1912, should not apply to the class of officers
described in the Schedule hereto for the special reasons assigned
by him :
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
declare that nothing in the Public Service Act, 1912, shall apply
to the class of officers described in the Schedule hereto.
