Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the Crimes Amendment Act, 1910, and of every other power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

The Honourable Archibald William Blair, a Judge of the Supreme Court,

to be President of the Prisons Board constituted under the Crimes Amendment Act, 1910, as aforesaid.

ORDER IN COUNCIL.

At the Government House at Wellington, this 24th day of February, 1943.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Lake County Council on the first day of October, one thousand nine hundred and forty-two, in so far as it affects the sides and portions of roads described in the Schedule hereto, viz.:

“The Lake County Council, being the local authority having control of the roads in the County of Lake, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of road adjoining Sections 8, 43, and 48, Block VI, Shotover Survey District, and contained in Certificates of Title, Volume 71, folio 174, and Volume 31, folio 141, Dunedin Registry, and to the eastern side of the portion of road adjoining Sections 8 and 48, Block VI, Shotover Survey District, and contained in Certificate of Title, Volume 71, folio 174, and to the eastern side of the portion of the road adjoining Sections 39 and 43, Block VI, Shotover Survey District, and contained in Certificate of Title, Volume 31, folio 141”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the sides and portions of roads (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.


SCHEDULE.

THE eastern side of all that portion of unnamed road in the Otago Land District, Lake County, fronting Sections 8 and 48, Block VI, Shotover Survey District; also all that portion of unnamed road situated in the said land district and county adjoining Sections 8, 48, and part Section 43, Block VI, Shotover Survey District; also the eastern side of all that portion of unnamed road situated in the said land district and county fronting Section 39 and part Section 43, Block VI, Shotover Survey District. As the said portions of roads are more particularly delineated on the plan marked P.W.D. 115721, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

HIS Excellency the Governor-General has been pleased to approve of the following appointments, promotions, transfers, resignations, and retirements of officers of the New Zealand Military Forces:—

STAFF.

Major G. H. Whyte, O.B.E., 2nd New Zealand Expeditionary Force, is granted the temporary rank of Lieutenant-Colonel whilst holding the appointment of a C.R.A.S.C. Dated 12th December, 1942.

Captain (temp. Major) J. H. Dunn, N.Z. Artillery, is granted the temporary rank of Lieutenant-Colonel whilst holding the appointment of Commandant of a School of Artillery. Dated 19th January, 1943.
