Authorizing Sylvia Louisa Martha Baker, of Te Anau, Petrol-reseller, to erect certain Electric Lines in Portion of the Township of Marakura, Te Anau

At the Government House at Wellington, this 22nd day of December, 1943

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize Sylvia Louisa Martha Baker, of Te Anau, Petrol-reseller (hereinafter referred to as “the licensee”), to lay, construct, put up, place, and use the electric lines described in the Schedule hereto on the following conditions.

CONDITIONS

  1. PURPOSES OF LINES

THE said lines may be used for lighting purposes only.

  1. LICENSE TO BE SUBJECT TO REGULATIONS

The license hereby conferred is subject to compliance by the licensee with the Electrical Wiring Regulations 1935 and the Electrical Supply Regulations 1935, and with all regulations made or to be made in amplification or amendment thereof or in substitution therefor.

The conditions directed to be implied in all licenses by the Electrical Supply Regulations 1935 shall be incorporated herein and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. SYSTEM OF SUPPLY

The system of supply shall be classified under paragraph (d) of clause 21–01 of the Electrical Supply Regulations 1935. Electrical energy shall be transmitted at a pressure of 230 volts alternating current between terminals.

  1. DURATION OF LICENSE

Unless sooner lawfully determined, this license shall continue in force until the 31st day of March, 1964, or until electrical energy is available from an Electric-power Board or other general public source, whichever is the earlier.

SCHEDULE

LINES adapted for supply as prescribed in these presents for the transmission of electrical energy commencing at a point in Te Anau Terrace opposite Section 39, Block I, Marakura Township, Te Anau, and proceeding thence along Te Anau Terrace in a north-westerly direction generally to the licensee’s petrol service station situated on Section 35, Block I, Marakura Township, Te Anau; the same being more particularly delineated by means of broken white lines on the plan marked P.W.D. 117694, deposited in the office of the Minister of Works at Wellington.

Revoking in Part an Order in Council authorizing Wairakei Limited to use Water from the Waikato River for the Purpose of generating Electricity and to erect Electric Lines

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

WHEREAS by Order in Council (hereinafter referred to as “the said license”) made on the ninth day of March, one thousand nine hundred and twenty-one, and published in the New Zealand Gazette of the eighteenth day of the same month at pages 698 and 699, and issued under the powers conferred by the Public Works Act, 1908, and the Public Works Amendment Act, 1911, and now by virtue of section three hundred and forty-six of the Public Works Act, 1928, deemed to have been issued under section three hundred and eighteen and section three hundred and nineteen of the last-named Act, His Excellency the Governor-General granted to Wairakei Limited (hereinafter called “the licensee”), subject to the terms and conditions set forth in the Schedule thereto, a license to take and use from the Waikato River, for the purposes therein set forth, a stream of water not exceeding 20 cubic feet per second at any one time, and also to erect and maintain certain electric lines as therein provided:

And whereas the said license was amended by Order in Council dated the twelfth day of December, one thousand nine hundred and thirty-five, and published in the New Zealand Gazette of the nineteenth day of the same month at page 3984:

And whereas by clause numbered twenty-one in the Schedule to the said license it was provided that notwithstanding anything contained in the said license, the Governor-General might by Order in Council revoke the said license, without payment of compensation, at any time after giving the licensee two years’ notice of intention to revoke the said license:

And whereas on the tenth day of October, one thousand nine hundred and forty-one, notice was duly served on the licensee giving to the licensee notice of intention on the expiration of two years from the date of service of the said notice to revoke the said license in so far as it operates as a license to take and use water from the Waikato River for the purposes set out in the said license, and to construct, maintain, and use the works described in paragraphs (a), (b), and (c) of the clause numbered four of the Schedule to the said license, as amended by the Order in Council dated the twelfth day of December, one thousand nine hundred and thirty-five, and published in the New Zealand Gazette of the nineteenth day of the same month at page 3984, but not so far as it operates as a license to erect and maintain electric lines as therein provided:

Now, therefore, in pursuance of the premises and in exercise of the powers conferred on me by the said license and by section three hundred and twenty-six of the Public Works Act, 1928, and of all other powers in anywise enabling me in this behalf, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby cancel and revoke the said license in so far as it operates as a license to take and use water from the Waikato River for the purposes set out in the said license, and to construct, maintain, and use the works described in paragraphs (a), (b), and (c) of the clause numbered four of the Schedule to the said license as amended by the Order in Council dated the twelfth day of December, one thousand nine hundred and thirty-five, and published in the New Zealand Gazette of the nineteenth day of the same month at page 3984, but not so far as it operates as a license to erect and maintain electric lines as therein provided.

Authorizing the Laying-off of a Street in the Town District of Papatoetoe (Omagh Avenue Extension) of a Width less than 66 ft. but not less than 50 ft., subject to a Condition as to the Building-line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and the Municipal Corporations Act, 1933, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Papatoetoe Town Board to permit the laying-off of the proposed street described in the Schedule hereto of a width less than 66 ft., but not less than 50 ft., subject to the condition that no building or part of a building shall at any time be erected on the land shown as Lot 5, D.P. 30668, on the plan marked P.W.D. 117375 referred to in the Schedule hereto, within a distance of 25 ft. from the northern boundary of the said street, or on the land shown as Lot 4, D.P. 30668, on the said plan marked P.W.D. 117375, within a distance of 15 ft. from the northern boundary of the said street, or on the land shown as Lot 7, D.P. 30668, on the said plan marked P.W.D. 117375, within a distance of 25 ft. from the southern boundary of the said street.

SCHEDULE

ALL that proposed street, in the North Auckland Land District, Papatoetoe Town District, being an extension of Omagh Street, containing by admeasurement 1 rood 2·2 perches, more or less, being part Lot 33 on a plan lodged in the Deeds Registry Office at Auckland under No. 15, and being part of Allotment 36 of the Parish of Manurewa. As the same is more particularly delineated on the plan marked P.W.D. 117375, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
