NOTICE is hereby given in pursuance of the Regulations Act, 1936, of the making of regulations and orders as under:—

Price Order No. 178 (Australian Oranges)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:—

This Order may be cited as Price Order No. 178, and shall come into force on the 30th day of November, 1943.

(1) In this Order, unless the context otherwise requires,—
“ The said regulations ” means the Control of Prices Emergency Regulations 1939* :
“ Bushel case ” means an Australian case of the type and specification used in the ordinary course of trade for packing the quantity of oranges recognized as one bushel.
(2) References in this Order to counts are references to the average number of oranges, according to size, customarily packed in a bushel case.
(3) References in this Order to metropolitan areas are references to the metropolitan areas described in the Second Schedule hereto.
(4) Terms and expressions defined in the said regulations and used in this Order have the meanings severally assigned thereto by the said regulations.
- The maximum prices fixed by this Order include the prices of the cases or other containers in which the oranges are delivered to the purchaser.

APPLICATION OF THIS ORDER

This Order applies with respect to all Australian oranges.

The maximum prices fixed by this Order apply with respect to sales by auction, as well as to other sales.
MAXIMUM WHOLESALE PRICES
- (1) Subject to the provisions of this clause, the maximum wholesale price of any oranges to which this Order applies shall be the appropriate wholesale price prescribed in the First Schedule hereto.
(2) The wholesale prices fixed by this Order are fixed as for delivery at the wholesaler’s store or other premises from which delivery to the purchaser is effected.
(3) Where delivery is effected by a wholesaler elsewhere than at premises occupied by him, he may add to the appropriate price fixed in accordance with the First Schedule hereto the reasonable cost of delivery, not exceeding in any case the cost that would have been incurred by him if delivery had been effected by a common carrier at current freight rates.
MAXIMUM RETAIL PRICES
- (1) Subject to the provisions of this clause, the maximum retail price of any oranges to which this Order applies shall be at the rate of the appropriate retail price prescribed in the First Schedule hereto.
(2) No oranges to which this Order applies shall be sold or offered or exposed for sale by any retailer otherwise than at the appropriate retail price per dozen fixed by this Order.
(3) If in respect of any lot of oranges sold by a retailer the maximum price calculated in accordance with the foregoing provisions of this clause is not an exact number of pence or half-pence, the maximum price of the lot shall be computed to the nearest upward halfpenny.
