Consenting to the Raising of a Loan of £7,000 by the Waimate Borough Council and prescribing the Conditions thereof

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the Waimate Borough Council (hereinafter called “the said local authority”) proposes, pursuant to the terms of a requisition issued under section twenty-two of the Health Act, 1920, to raise a loan of seven thousand pounds (£7,000), to be known as “Drainage and Sewerage Loan, 1943” (hereinafter called “the said loan”), for the purpose of providing drainage works, sewerage works, and works for the disposal of sewage to afford an efficient drainage and sewerage service for the public hospital, for the area in the borough known as Masseytown, and for the area north and west of Naylor Street and Hill Road:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of seven thousand pounds (£7,000), and in giving such consent doth hereby determine as follows:—
(1) The term for which the said loan or any part thereof may be raised shall not exceed twenty-five (25) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.
(3) The said loan or any part thereof shall be repaid by the annual redemption of debentures in the years and of the amounts as set out in the Schedule hereto.

(4) The payment of interest and the redemptions in respect of the said loan shall be made in New Zealand.
(5) No amount payable either as interest or as a redemption in respect of the said loan shall be paid out of loan-moneys.
(6) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.
(7) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

PURSUANT to section one hundred and sixty-seven of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary an Order in Council made on the fourth day of April, one thousand nine hundred and thirty-two, and published in the Gazette on the seventh day of April, one thousand nine hundred and thirty-two, at page 735, and affecting Hauturu East B 2 Section 2A 1A and other blocks, by excluding therefrom the lands described in the Schedule hereto.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserves described in the Schedule below (being land reserved under the said Act), for the period of five years from the date hereof (unless previously altered or revoked under the said Act), in the undermentioned persons, namely,—
The Commissioner of Crown Lands for the Taranaki Land District, ex officio,
His Worship the Mayor of New Plymouth, ex officio,
Victor Caddy Davies,
Edmund William Markham Lysons, and
William Henry Skinner,
who are hereby constituted for that purpose a special Board by the name of the New Plymouth Scenic Reserves Board (herein referred to as “the Board”), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say,—
- The Board shall meet for the transaction of business on the fourth Thursday in the months of January, April, July, and October in each year, at four o'clock p.m., at the District Lands and Survey Office, New Plymouth, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Thursday, the twenty-seventh day of January, one thousand nine hundred and forty-four.
