Portion of unnamed Road, in the County of Marlborough, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 30th day of September, 1942.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Marlborough County Council on the seventeenth day of July, one thousand nine hundred and forty-two (in so far as it affects the side and portion of road described in the Schedule hereto), viz. :

“ The Marlborough County Council, being the local authority having control of the roads in the County of Marlborough, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of that portion of road adjoining part of Allotment 5, D.P. 482, being part of Section 55, Wairau West Block XI, Cloudy Bay Survey District, and contained in Certificate of Title, Volume 25, folio 15 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of an unnamed road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

The western side of all that portion of unnamed road situated in the Marlborough Land District, fronting part Lot 5, D.P. 482, being part Section 55, District of Wairau West. As the same is more particularly delineated on the plan marked P.W.D. 115130, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ The Waitemata County Council, being the local authority having control of the roads in the County of Waitemata, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of road adjoining Lots 1 and 2 on L.T. 28417, being Subdivision of Allotment 393 and parts 6 and 7 of Allotment 7a, Waipareira Parish ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Rua-o-te-Whenua Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

The north-eastern side of all that portion of road situated in the North Auckland Land District, Waitemata County, known as Rua-o-te-Whenua Road, fronting Allotment 393, Waipareira Parish, Block V, Titirangi Survey District. As the same is more particularly delineated on the plan marked P.W.D. 112326, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Vesting a Reserve in the Whangarei Borough Council.

ORDER IN COUNCIL.

At the Government House at Wellington, this 30th day of September, 1942.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for municipal purposes : And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Mayor, Councillors, and Burgesses of the Borough of Whangarei :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Mayor, Councillors, and Burgesses of the Borough of Whangarei, in trust, for municipal purposes.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

All that area in the Whangarei Borough, situated in Block IX, Whangarei Survey District, containing by admeasurement 18-13 perches, more or less, being Lot 7 on Deposited Plan No. 19587, being portion of Allotment 2 of the Parish of Whangarei.
