The Wellington and Hutt Valley Bread Delivery Notice 1942.

PURSUANT to Regulation 4 of the Delivery Emergency Regulations 1942* the Minister of Transport doth hereby give notice as follows :—

  1. This notice may be cited as the Wellington and Hutt Valley Bread Delivery Notice 1942.
  2. This notice shall come into force on the 21st day of September, 1942.
  3. The scheme set out in the Schedule hereto is hereby provided for the said district.

SCHEDULE.

THE WELLINGTON AND HUTT VALLEY BREAD DELIVERY SCHEME, 1942.

(1) For the purposes of this scheme, unless the context otherwise requires,—

“ The district ” means the area constituted as follows : The cities of Wellington and Lower Hutt ; the boroughs of Upper Hutt, Petone, and Eastbourne ; the Town District of Johnsonville ; that portion of Makara County lying to the south of a line drawn in a due westerly direction from the northern extremity of the boundary of Johnsonville Town District to the sea ; that portion of Hutt and Makara Counties bounded to the north by the Pakuratahi River at the foot of the Rimutaka Range, to the west by the Hutt River from the Pakuratahi River to the Akatarawa River ; thence by a line following generally along the top of the Western Hutt hills to the northern extremity of the boundary of Johnsonville Town District ; thence along the eastern boundary of Johnsonville Town District and the northern boundary of Wellington City to the waters of Wellington Harbour at Ngahauranga, to the south by the waters of the said harbour, and to the east by a line following generally along the top of the Eastern Hutt hills from the north-eastern extremity of the boundary of Eastbourne Borough to the Pakuratahi River near the foot of the Rimutaka Range, but including within the area the settlements of Stokes Valley, Whiteman’s Valley, and the valley of the Wainui-o-mata River :

“ Minister ” means the Minister of Transport :

“ Wholesale purchaser ” means either—

(a) A person who purchases not less than thirty-six 2 lb. loaves per week or their equivalent in weight ; or
(b) A hospital.

(2) For the purpose of assisting in the administration of this scheme there shall be two committees as follows :—

(i) *Wellington Committee*—

    (a) Two members to be appointed by the Wellington City Council :
    (b) One member to be appointed by the Wellington Master Bakers’ Association :
    (c) The Zoning Officer for the North Island.

(ii) *Hutt Valley Committee*—

    (a) Two members to be appointed by the Minister from nominations submitted to the Minister by the Lower Hutt City Council, Petone Borough Council, Upper Hutt Borough Council, and Eastbourne Borough Council, as representatives of those local authorities, such nominations to be submitted in accordance with the provisions of clause (3) of this scheme :
    (b) One member to be appointed by the Wellington Master Bakers’ Association :
    (c) One member to be appointed by the Hutt Valley Sub-Association of the Wellington Master Bakers’ Association :
    (d) The Zoning Officer for the North Island.

(3) For the purposes of clause 2 (ii) (a) of this scheme each of the Councils specified therein shall, by resolution, as soon as may be after the coming into force of this scheme, nominate one person for membership of the Hutt Valley Committee, and shall submit the nomination to the Minister.

(4) (a) The members to be appointed to the Wellington and Hutt Valley Committees by the Wellington City Council, the Wellington Master Bakers’ Association, and the Hutt Valley Sub-Association of the Wellington Master Bakers’ Association under clause (2) of this scheme shall be appointed by resolutions of the Council, Association, and Sub-Association respectively, as soon as may be after the coming into force of this scheme.

(b) Any committee member appointed by the said Council, Association, or Sub-Association, as the case may be, may in like manner be removed from office.

(5) Where any member appointed by the Minister to the Hutt Valley Committee under clause 2 (ii) of this scheme is also a member of any one of the Councils specified in the said clause 2 (ii) (a), and that member vacates his seat as a member of that Council, the vacating member shall be deemed to have vacated his office as a member of the committee.

(6) Any committee member, other than the Zoning Officer, may resign his office by writing addressed to the Minister.

(7) (a) On the death or resignation of any member of the Hutt Valley Committee appointed by the Minister under clause 2 (ii) (a) of this scheme, or where any such member vacates his office under clause (5) of this scheme, the Minister may, in place of the vacating member, appoint another person from nominations which shall be submitted to the Minister by each of the Councils referred to in the said clause 2 (ii) (a), in the manner specified in clause (3) of this scheme. Any such member so resigning or vacating his office may, if renominated under this clause, be reappointed to the committee.

(b) On the death, resignation, or removal from office of any other committee member, other than the Zoning Officer, the vacancy created thereby shall be filled by appointment in the manner in which the vacating member was appointed.

(8) The functions of each committee shall be to receive and investigate complaints affecting the administration of this scheme in its area, to advise the Minister on any matters that may be referred to the committee by the Minister or that may be considered by it of its own motion, and to make recommendations to the Minister for amending this scheme.

(9) Subject to the foregoing provisions of this scheme, each committee may regulate its procedure in such manner as it thinks fit.

(10) It shall be a condition of this scheme that bread shall be delivered within the district to the premises of wholesale purchasers only.

(11) It shall be a condition of this scheme that, with the exception of deliveries made pursuant to a contract with the Crown, a party to the scheme shall deliver bread only to the wholesale purchasers allotted to him as provided in clause (13) of this scheme.

(12) It shall be a condition of this scheme that each party to the scheme shall forward not later than on the Wednesday of each week to the Secretary of the Wellington Master Bakers’ Association, in a form to be supplied by the Secretary, a correct return of the total amount of flour held by that party at the end of the last preceding week, together with particulars of the amounts of the bread baked, the bread sold, and the flour used for eatables other than bread during that week.

(13) The names and addresses of the vendors who are parties to this scheme and the wholesale purchasers to whom they may deliver bread are as follows :—
