Portions of Roads in the County of Waitaki exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 9th day of September, 1942.
Present:
THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the twenty-second day of May, one thousand nine hundred and forty-two, viz.—
“The Waitaki County Council, being the local authority having control of the roads in the County of Waitaki, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portions of roads described in the Schedule hereto :—
“SCHEDULE.
“The eastern side of the portion of road adjoining part Section 1 of 28, Block I, Otepopo Survey District, marked A–B on plan P.W.D. 114324.
“The eastern side of the portion of road adjoining Section 38, Block I, Otepopo Survey District, marked C–D on plan P.W.D. 114324.
“All that portion of road adjoining Section 38 and parts Sections 59, 62, 84, 85, 86, and 87, Block I, Otepopo Survey District, marked D–E on plan P.W.D. 114324.
“The western side of the portion of road adjoining Section 63 and part Section 62, and closed road, Block I, Otepopo Survey District, marked E–F on plan P.W.D. 114324.
“The western side of the portion of road adjoining part Section 62 and Sections 61, closed road, 35B, and 35A, Block I, Otepopo Survey District, marked E–G on plan P.W.D. 114324.
“The eastern side of the portion of road adjoining Sections 78 and 80 and closed road, Block I, Otepopo Survey District, marked H–K on plan P.W.D. 114324 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said portions of roads (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.

The eastern side of the portion of road adjoining Section 1 of 28, Block I, Otepopo Survey District, marked A–B.
The eastern side of the portion of road adjoining Section 38, Block I, Otepopo Survey District, marked C–D.
All that portion of road adjoining or passing through Sections 38, 59, 62, 84, 85, 86, and 87, and closed road, Block I, Otepopo Survey District, marked D–E.
The western side of the portion of road adjoining Section 63 and part Section 62 and closed road, Block I, Otepopo Survey District, marked E–F.
The western side of the portion of road adjoining part Section 62 and Section 61, closed road, and Sections 35B and 35A, Block I, Otepopo Survey District, marked E–G.
The eastern side of the portion of road adjoining Sections 78 and 80 and closed road, Block I, Otepopo Survey District, marked H–K.
All in the Waitaki County, Otago Land District; as the same are more particularly delineated on the plan marked P.W.D. 114324, deposited in the office of the Minister of Public Works at Wellington, and thereon marked as above mentioned and coloured red.

The North-western Side of Portion of Office Road, and the North-eastern Side of Portion of Milsom Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the twenty-seventh day of July, one thousand nine hundred and forty-two, viz. :—
“The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, hereby, by resolution, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of the portion of Milsom Street adjoining the land comprised in Certificate of Title 386/244, R.S. 105, and to the north-western side of the portion of Office Road adjoining the land comprised in Certificates of Title 269/135 and 386/244, R.S. 105 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Office Road or the north-eastern side of the portion of Milsom Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of street.
SCHEDULE.
The north-western side of all that portion of street situated in the Canterbury Land District, City of Christchurch, known as Office Road, fronting part Rural Section 105.
Also the north-eastern side of all that portion of street situated in the said land district and city, known as Milsom Street, fronting parts Rural Section 105.
As the same are more particularly delineated on the plan marked P.W.D. 114495, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Cancelling the Reservation over Part of a Reserve in Block XII, Waimea Survey District, Westland Land District.

ORDER IN COUNCIL.
At the Government House at Wellington, this 2nd day of September, 1942.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby cancel the reservation for police and other Government purposes over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.
SCHEDULE.
All that area in the Westland Land District containing 3 roods 13·2 perches, more or less, being part Reserve 219, Town of Kumara, Block XII, Waimea Survey District, and bounded as follows: On the north-west by the Town Belt West, 150 links; on the north-east by Tui Street, 555·04 links; on the south-east by a right line, 150 links; and on the south-west by Camp Street, 555·04 links. As the same is more particularly delineated on the plan marked L. and S. 6/7/182A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Vesting a Reserve in the Horowhenua County Council.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 9th day of September, 1942.
Present:
THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL.
WHEREAS the land described in the Schedule hereto has been duly set apart for county purposes: And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Horowhenua County Council:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Horowhenua County Council, in trust, for county purposes.

WELLINGTON LAND DISTRICT.
SECTION 22, Horowhenua Village Settlement, Block I, Waiopehu Survey District: Area, 5 acres.
