(2) The growers’ prices as aforesaid are fixed in respect of sales f.o.r.s.i. the station nearest or most convenient of access to the grower’s premises (hereinafter referred to as the “grower’s station”).

(3) Where any onions sold by a grower are delivered by him otherwise than f.o.r.s.i. the grower’s station, as aforesaid, the maximum price that may be charged by the grower shall be the price fixed in accordance with the last preceding subclause, increased by the amount of the charges (if any) incurred by him in effecting delivery, and then reduced by the amount of the charges that would have been incurred by him if he had delivered the onions f.o.r.s.i. the grower’s station.

Distributors’ Prices.

  1. (1) The maximum price that may be charged or received by any distributor for any onions to which this Order applies shall be :—

(a) For onions grown in the South Island and delivered f.o.b.s.i., £33 a ton ;

(b) For onions grown in the South Island and delivered f.o.r.s.i., £32 10s. a ton ;

(c) For onions grown in the North Island and delivered f.o.r.s.i., £34 10s. a ton.

(2) Where any onions sold by a distributor are delivered by him otherwise than f.o.b.s.i. or f.o.r.s.i., as aforesaid, the maximum price that may be charged by the distributor shall be the price fixed in accordance with the last preceding subclause, reduced by the amount of the charges that would have been incurred by him if he had delivered the onions f.o.b.s.i. the nearest or most convenient port of shipment, or f.o.r.s.i. the nearest or most convenient station.

(3) Notwithstanding anything in the foregoing provisions of this clause the price charged by a distributor for any onions to which this Order applies shall not in any case exceed the price paid to the grower, increased by :—

(a) £1 10s. a ton in respect of any onions delivered by him f.o.r.s.i. ; or

(b) £2 a ton in respect of any onions delivered by him f.o.b.s.i.

Wholesalers’ Prices.

  1. (1) The maximum price that may be charged or received by any wholesaler for any onions to which this Order applies shall be the sum of the following amounts :—

(a) The price actually paid or payable by the wholesaler to the grower or any other person ;

(b) Any transport or other charges payable by the wholesaler ;

(c) An amount equal to 2½ per cent. of the sum of the amounts specified in paragraphs (a) and (b) hereof (to cover the estimated loss due to shrinkage or other natural causes) ; and

(d) An amount computed at the rate of £2 a ton.

(2) For the purposes of this Order, and notwithstanding anything to the contrary in the said regulations, any person who sells any onions by retail, in quantities of not less than 5 cwt. to any one purchaser for delivery at one time, shall in respect of such sale be deemed to be a wholesaler, and the provisions of the last preceding subclause shall apply accordingly with respect to every such sale.

Retailers’ Prices.

  1. (1) Except as provided in subclause (2) of the last preceding clause, the maximum price that may be charged or received by any retailer for any onions to which this Order applies shall be the sum of the following amounts :—

(a) The price actually paid or payable by the retailer for the onions ;

(b) Any transport or other charges paid or payable by the retailer in respect of the onions ;

(c) An amount equal to 40 per cent. of the sum of the amounts specified in paragraphs (a) and (b) hereof ; or 6d. a pound (whichever is the less).

(2) The retail price of any onions, computed in accordance with the last preceding subclause, shall be calculated by reference to the prices and weights disclosed in the appropriate invoices.

IN pursuance of the powers conferred on it by the Control of Prices Emergency Regulations 1939, the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order :—

  1. This Order may be cited as Price Order No. 105, and shall be read together with and deemed part of Price Order No. 66* (hereinafter referred to as “the principal Order”).

  2. The Schedule to the principal Order is hereby amended by deleting therefrom the provisions relating to gurnard and trevalli, and substituting the following provisions :—
