Portion of Factory Road, in the County of Taieri,
exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as
to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of
June, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred
by the Public Works Act, 1928, and of every
other power in anywise enabling him in this behalf,
His Excellency the Governor-General of the Dominion
of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion,
doth hereby approve of the following resolution passed
by the Taieri County Council, on the twenty-fourth day
of April, one thousand nine hundred and forty-two,
viz.:

"The Taieri County Council, being the local
authority having control of the roads in the County
of Taieri, by resolution declares that the provisions
of section one hundred and twenty-eight of the
Public Works Act, 1928, shall not apply to the
southern side of Factory Road, adjoining Section
10, Block I, East Taieri District";

subject to the condition that no building or part of
a building shall at any time be erected on the land
fronting the southern side of portion of Factory Road
(described in the Schedule hereto) within a distance of
thirty-three feet from the centre-line of the said
portion of road.

SCHEDULE.

THE southern side of all that portion of road in the
Otago Land District, County of Taieri, known as
Factory Road, fronting Section 10, Block I, East
Taieri District. As the same is more particularly
delineated on the plan marked P.W.D. 114286, deposited
in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

The Customs Excise Tobacco Duty Order 1942.

ORDER IN COUNCIL.

At the Government House at Wellington, this 17th day of
June, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to section twenty-five of the Customs
Acts Amendment Act, 1930, His Excellency the
Governor-General, acting by and with the advice and
consent of the Executive Council, it being the opinion
of the Minister of Customs that the manufacture of
cigars and snuff containing less than seventy-five per
centum of tobacco grown in New Zealand is unduly
detrimental to the public revenues, doth hereby order
as follows:—

  1. This Order may be cited as the Customs Excise
    Tobacco Duty Order 1942.

  2. The Customs Excise Tobacco Duty Order 1941*
    is hereby revoked.

  3. There is hereby prescribed an excise duty at the
    rate of fourteen shillings per pound on all cigars and
    snuff containing less than seventy-five per centum of
    tobacco grown in New Zealand, which may be made
    in any calendar year commencing with the year 1942,
    by or on behalf of G. Pezaro and Son, Limited, of
    Auckland, in excess of a maximum quantity of seven
    thousand pounds’ weight of such cigars and snuff.

Appointing the Chairman of the Soil Conservation and Rivers
Control Council.

IN pursuance and exercise of the powers vested in me by
section four of the Soil Conservation and Rivers Control
Act, 1941, and of all other powers and authorities in anywise
enabling me in this behalf, I, Cyril Louis Norton Newall, the
Governor-General of the Dominion of New Zealand, do
hereby appoint—

William Langston Newnham, Esquire,
the Engineer-in-Chief of the Public Works Department,
to be the Chairman of the Soil Conservation and Rivers
Control Council.

As witness the hand of His Excellency the Governor-
General, this 15th day of June, 1942.
