Varying the Determinations in respect of the Christchurch Drainage Board’s Loan of £234,500.

At the Government House at Wellington, this 17th day of December, 1941.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council made on the nineteenth day of November, one thousand nine hundred and forty-one, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Christchurch Drainage Board (hereinafter called “the said local authority”) of the sum of two hundred and thirty-four thousand five hundred pounds (£234,500) by a loan to be known as “Conversion Loan Repayment Loan, 1941” (hereinafter called “the said loan”):

And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to vary the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that in lieu of no amount being payable for brokerage, underwriting, or procurement fees in respect of the raising of the said loan or any part thereof, as provided in clause six of the said Order in Council, an amount may be payable for such purpose not exceeding one-quarter per centum of any amount raised.

Authorizing the Laying-off of a Street off Victoria Avenue, in the City of Auckland, of a Width less than 66 ft. but not less than 54 ft., subject to a Condition as to the Building-line.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Auckland City Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet, but not less than fifty-four feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the said street within a distance of forty-eight feet from the centre-line of the said street.

SCHEDULE.

THAT proposed street in the North Auckland Land District, City of Auckland, containing by admeasurement 1 acre 1 rood 15 perches, more or less, being part Allotment 85, Section 16, Suburbs of Auckland, as appears on D.P. 3779. As the same is more particularly delineated on the plan marked P.W.D. 112414, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Authorizing John George Strongman, of Coromandel, Mechanical Engineer, to erect certain Electric Lines in Portion of the County of Coromandel.

THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize John George Strongman, of Coromandel, Mechanical Engineer (hereinafter referred to as “the licensee”), to lay, construct, put up, place, and use the electric lines described in the Schedule hereto on the following conditions.

CONDITIONS.

  1. PURPOSES OF THE LINES.

THE said lines may be used for lighting, power, and heating purposes.

  1. LICENSE TO BE SUBJECT TO REGULATIONS.

The license hereby conferred is subject to compliance by the licensee with the Electrical Wiring Regulations 1935, the Electrical Supply Regulations 1935, and with all regulations made or to be made in amplification or amendment thereof or in substitution therefor.

The conditions directed to be implied in all licenses by the Electrical Supply Regulations 1935 shall be incorporated herein, and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. SYSTEM OF SUPPLY.

The system of supply shall be classified under paragraphs (a) and (f) of clause 21–01 of the Electrical Supply Regulations 1935.

  1. GENERATING VOLTAGE.

Electrical energy shall be generated at a pressure of 400 volts alternating current between terminals and transformed up to 3,300 volts for transmission purposes.

  1. DURATION OF LICENSE.

Unless sooner lawfully determined, this license shall continue in force until the 31st day of March, 1962, or until electrical energy is available from an Electric-power Board or other general public source, whichever is the earlier.

  1. CHARGES ON SALE.

Maximum Charges.

(1) The licensee shall not in respect of electrical energy distributed under the authority of this license make any charges exceeding those set out hereunder:—

(a) In the case of a wholesale supply, a sum of £16 per kilovolt-ampere of maximum demand per annum plus a sum of one halfpenny per unit.

(b) In the case of a supply for lighting purposes, a sum of one shilling per unit, reducible on payment within fourteen days of due date to ninepence per unit.

(c) In the case of a supply for motor-power, heating, cooking, or any purpose other than lighting purposes, other than a wholesale supply, a sum of sixpence per unit, reducible on payment within fourteen days of due date to fourpence halfpenny per unit.

Minimum Charges.

(2) Notwithstanding the foregoing provisions, the licensee may in the case of any supply make such minimum charge as may be authorized by regulations.

Intervals of Payment.

(3) Payment shall not be demanded from any consumer on dates at intervals apart of less than twenty-one days.

Definitions.

(4) For the purposes of this regulation—

“Wholesale supply” means a supply in respect of which the consumer contracts to pay a sum of £180 or more for any period not exceeding one year:

“Lighting purposes” includes the operation of motor-generators for lighting purposes and the charging of batteries or accumulators used solely or principally for lighting purposes.”

SCHEDULE.

LINES adapted for supply as prescribed in these presents for the transmission of electricity leading from the licensee’s generating plant situated on Lots 10 and 11 of Section 1, Te Umuhau Block, Coromandel Survey District, and proceeding thence in a south-westerly direction along Pound Road to the junction of Pound Road and the Thames-Coromandel Main Highway; thence (a) in a southerly direction generally along the Thames-Coromandel Main Highway for a distance of approximately 205 chains with branch lines along Whangapoua Road, Albert Road, McQuoid’s Road, and Quarry Road; (b) in a northerly direction generally along the Thames-Coromandel Main Highway, Kaponga Road, and Ring’s Road to the junction of Colville Road and Kennedy’s Bay Road; thence along Colville Road for a distance of approximately 30 chains and along Kennedy’s Bay Road for a distance of approximately 25 chains, with branch lines along Wollams Street, Ti Tiki Road, Watts Road, Albert Street, Victoria Street, Pagitts Street, Edward Street, Alfred Street, Oxford Terrace, Success Road, and Kelso Lane; (c) in a north-westerly direction generally along the Thames-Coromandel Main Highway, Wharf Road, Blackmore’s Road, and Long Bay Road to the Coromandel Centennial Camping-ground, with branch lines along Hauraki Road and the Coromandel Wharf; the aforesaid lines being more particularly delineated by means of green lines and yellow lines on plan P.W.D. 112378, deposited in the office of the Minister of Public Works at Wellington.
