The Vegetable Production Statistics Notice 1942.

PURSUANT to the Primary Industries Emergency Regulations 1939,* the Minister of Agriculture doth hereby give directions in accordance with the provisions of this notice.

NOTICE TO OCCUPIERS OF COMMERCIAL GARDENS.

  1. This notice may be cited as the Vegetable Production Statistics Notice 1942.
  2. (1) In this notice, unless the context otherwise requires:—
    “The said regulations” means the Primary Industries Emergency Regulations 1939*:
    “Commercial garden” means any land used for the production of vegetables for sale for human consumption, and includes any such land enclosed within a glasshouse:
    “Controller” means the Primary Industries Controller appointed under the said regulations:
    “Occupier” means the person by whom or on whose behalf any commercial garden is actually occupied:
    “Vegetables” includes all crops of the several kinds specified in the Schedule hereto, and also includes vegetables of any other kind produced in a commercial garden, but does not include potatoes.
    (2) For the purposes of this notice vegetables intended for use in the manufacture of any food intended for sale for human consumption shall be deemed to be intended for sale for human consumption.

APPLICATION OF THIS NOTICE.

  1. (1) Except as provided in the next succeeding subclause, this notice applies with respect to every commercial garden in New Zealand.
    (2) This notice does not apply with respect to commercial gardens of any of the following classes, namely,—
    (a) A commercial garden consisting solely of land enclosed within a glasshouse, and containing an area less than 2,500 square feet.
    (b) A commercial garden no part of which is enclosed within a glasshouse, and containing an area less than one-half acre.
    (c) A commercial garden part of which is enclosed within a glasshouse, if the total area of the garden is less than one-half acre computed in accordance with the special provisions of this paragraph. For the purposes of this paragraph the area of that portion of a commercial garden that is enclosed within a glasshouse shall be computed at the rate of 5,000 square feet per acre.
    (3) For the purposes of this clause two or more areas in the occupation of the same person for the purposes of a commercial garden shall be deemed to constitute one commercial garden.

DIRECTIONS TO OCCUPIERS OF COMMERCIAL GARDENS WITH RESPECT TO WHICH THIS NOTICE APPLIES.

  1. Every occupier of a commercial garden with respect to which this notice applies shall on or before the 1st day of February, 1943, complete and deliver to the Controller, or to such officer of the Department of Agriculture as the Controller may appoint for the purpose, a return in the form set out in the Schedule hereto or to the effect thereof, setting out the several particulars indicated in the said form.
